On some issues of the State Youth Prize "Daryn"

Order of the Minister of Information and Social Development of the Republic of Kazakhstan dated July 1, 2023 No. 271-НҚ. Registered in the Ministry of Justice of the Republic of Kazakhstan on July 1, 2023 No. 33016.

In accordance with subparagraph 12) of Article 6 of the Law of the Republic of Kazakhstan "On State Youth Policy" I ORDER:

  1. Approve:

1) Rules for awarding the State Youth Prize "Daryn" in accordance with Appendix 1 to this order;

2) Nominations of the State Youth Prize "Daryn" in accordance with Appendix 2 to this order.

  1. The Committee for Youth and Family Affairs of the Ministry of Information and Social Development of the Republic of Kazakhstan, in accordance with the procedure established by the legislation of the Republic of Kazakhstan, shall ensure:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) posting this order on the Internet resource of the Ministry of Information and Social Development of the Republic of Kazakhstan;

3) within ten working days after the state registration of this order with the Ministry of Justice of the Republic of Kazakhstan, submission to the Legal Department of the Ministry of Information and Social Development of the Republic of Kazakhstan of information on the implementation of the measures provided for in subparagraphs 1) and 2) of this paragraph.

  1. Control over the implementation of this order shall be assigned to the supervising Vice Minister of Information and Social Development of the Republic of Kazakhstan.
  2. This order shall come into effect upon expiration of ten calendar days after its first official publication.

Rules
for awarding the State Youth Prize "Daryn"

Chapter 1. General Provisions

  1. These Rules for awarding the State Youth Prize "Daryn" (hereinafter referred to as the Rules) have been developed in accordance with subparagraph 12) of Article 6 of the Law of the Republic of Kazakhstan "On State Youth Policy" and determine the procedure for awarding the State Youth Prize "Daryn".
  2. The State Youth Prize "Daryn" (hereinafter referred to as the Prize) is awarded annually in nominations approved by the authorized body on issues of state youth policy (hereinafter referred to as the authorized body), for the purpose of state support of talented youth for fruitful scientific, creative, social activities, as well as for high sporting achievements.
  3. The amount of the monetary reward of the bonus is established by the authorized body annually within the limits of budgetary funds intended for the implementation of activities of the relevant budget programs (subprograms) for the relevant financial year.

Chapter 2. The procedure for awarding the State Youth Prize "Daryn"

  1. Citizens of the Republic of Kazakhstan under the age of 35 (thirty-five) years at the time of the deadline for accepting applications for the award, who are laureates of international and national competitions, festivals and exhibitions, prize winners and winners of national and international sports competitions, as well as candidates whose activities are innovative and contribute to the development of the relevant industry and society as a whole, may apply for the award.

The prize is awarded simultaneously to no more than 2 (two) applicants in each nomination. When the prize is awarded simultaneously to 2 (two) applicants in each nomination, its monetary part is divided equally between them.

The award may not be repeated. The same candidate may not be nominated for the award in more than one nomination.

When a prize is awarded to a group of authors, its monetary portion is divided equally among its members.

  1. Nominations for the award are submitted by central, local and other government bodies, public associations and other legal entities registered in the territory of the Republic of Kazakhstan.
  2. The prize is awarded by order of the authorized body based on the decision of the Commission for Awarding the State Youth Prize "Daryn" (hereinafter referred to as the Commission), created under the authorized body.

The commission is formed from among representatives of the authorized body, central government bodies, scientists, creative workers, public figures, members of the Council on Youth Policy under the President of the Republic of Kazakhstan, and persons enrolled in the Presidential Youth Personnel Reserve.

The composition of the Commission is approved by order of the authorized body.

The total number of members of the Commission shall be an odd number, but not less than 15 (fifteen) persons. Members of the Commission shall participate in the activities of the Commission without the right of replacement.

The commission is headed by a chairman, and in his absence, by a deputy chairman.

A member of the Commission shall not participate in the consideration of applications for the award if he/she has a direct or indirect interest (conflict of interest) and is subject to recusal (self-recusal).

A member of the Commission shall notify the Chairman of the Commission in writing of a conflict of interest that has arisen or the possibility of its arising.

Self-recusal and recusal are motivated and declared both before the start of the meeting and during the meeting of the Commission.

The decision on the self-recusal (recusal) of a member of the Commission shall be made by the Commission in writing, by a majority of votes of its members participating in the meetings, and shall be announced in the presence of the member of the Commission.

  1. The announcement of the acceptance of applications for the award shall be posted on the Internet resource of the authorized body no later than 2 (two) months before the end of the period for accepting applications for the award.
  2. The acceptance of applications for the award begins from the moment the announcement of the acceptance of applications is made and ends 2 (two) months before the award ceremony.
  3. Central, local and other state bodies, public associations and other legal entities registered in the territory of the Republic of Kazakhstan (hereinafter referred to as nominating organizations) shall send the following documents to the authorized body in paper and electronic form:

1) a copy of the candidate’s identity document;

2) a registration application for the State Youth Prize "Daryn" in the form in accordance with the appendix to these Rules;

3) a petition and a certificate of the award applicant’s achievements;

4) copies of award diplomas, certificates, letters of gratitude (if any);

5) copies of articles, publications of the candidate or about the candidate (if any);

6) a copy of the certificate of existence of a bank account;

7) supporting materials on the candidate’s achievements (if any).

The authorized body accepts and registers the documents received for the award applicant within one day.

If an incomplete set of documents is submitted, no later than 5 (five) working days from the date of receipt of the application, the authorized body shall send a notice of the need to submit an application for the award in accordance with the first part of this paragraph, by registered mail with acknowledgment of receipt or to the e-mail addresses of the nominating organizations.

Nominating organizations shall, within 3 (three) working days from the date of receipt of notification, submit missing documents to the authorized body in paper and electronic form.

The authorized body submits applications for consideration by the Commission, revised taking into account the comments specified in the notification.

If the application fails to comply with the requirements specified in the first part of this paragraph within the period specified in the notification, the authorized body shall return the application for the award to the applicant within 3 (three) working days.

  1. The nominating organizations are responsible for organizing the Commission’s viewings of performances, films and television films, exhibitions, listening to concert programs, as well as musical and literary works, and familiarization with the applicant’s activities.
  2. Candidates nominated for the prize are considered by the Commission in two stages.

At the first stage, for the purpose of a comprehensive review, 6 (six) sections are created from among the members of the Commission in the following areas: "Variety, classical music, folk art", "Literature, theater and cinema", "Journalism and social activities", "Sports", "Design and fine arts", "Science".

The work of the section is headed by a leader appointed by the Chairman of the Commission from among the members of the Commission.

The meetings of the sections are recorded in minutes, signed by the members of the Commission present and submitted for consideration at the final meeting of the Commission.

At the second stage, the Commission makes a decision on awarding the prize.

The final meeting of the Commission is held on the principles of openness and transparency using audio and/or video recording.

  1. The Commission's decision to approve a candidate for the award is made at a meeting of the Commission by open vote and a simple majority of votes. In the event of a tie, the decision voted for by the Chairman is considered adopted. In the absence of the required number of votes, the award is not awarded. The meeting is considered valid if more than half of the members of the Commission are present.

  1. The authorized body shall publish the draft protocol on the results of the competition on the Internet resource of the authorized body, no later than 3 (three) working days before signing the protocol on the results of the competition.

The nominating organizations shall submit objections to the draft protocol no later than 2 (two) working days from the date of receipt of notification with the draft protocol.

Unless otherwise provided by law, an appeal to the court is permitted after an appeal in a pre-trial procedure.

The decision of the Commission is drawn up in a protocol and signed by the members of the Commission present.

The protocol shall indicate the candidates for the award of the prize and the candidates to whom the prize is not awarded, with an indication of the reasons.

  1. The authorized body, based on the decision of the Commission, issues an order to award the prize.

  1. The order for awarding the prize is published in the mass media, including the Internet resource of the authorized body.

  1. Persons awarded the prize are awarded the title of "Laureate of the State Youth Prize "Daryn" and are presented with a diploma, a badge and a cash reward.
  2. The awards are presented in a formal ceremony.

The authorized body shall transfer the monetary reward to the bank account of the person awarded the prize no later than 15 (fifteen) working days from the date of the order to award the prize.
