- General Provisions
- State institution "Department of Architecture, Urban Planning and Construction of the Akimat of Beimbet Mailin District " is a state body of the Republic of Kazakhstan that carries out state functions in the field of architectural, urban planning and construction activities. The founder of the state institution "Department of Architecture, Urban Planning and Construction of the Akimat of the Beimbet Mailin District " is the state represented by the Akimat of the District of Beimbet Mailin . 2. The state institution "Department of Architecture, Urban Planning and Construction of the Akimat of the Beimbet Mailin District " has no departments.
3. The state institution "Department of Architecture, Urban Planning and Construction of the Akimat of the Beimbet Mailin District " operates in accordance with the Constitution of the Republic of Kazakhstan and the laws of the Republic of Kazakhstan, acts of the President and the Government of the Republic of Kazakhstan, other regulatory legal acts, as well as this Regulation. 4. The state institution "Department of Architecture, Urban Planning and Construction of the Akimat of the Beimbet Mailin District " is a legal entity in the organizational and legal form of a state institution, has a seal and stamps with its name in the state language, forms of the established sample in accordance with the legislation of the Republic of Kazakhstan, accounts in the authorities treasury. 5. The state institution "Department of Architecture, Urban Planning and Construction of the Akimat of the Beimbet Mailin District " enters into civil law relations on its own behalf. 6. The state institution "Department of Architecture, Urban Planning and Construction of the Akimat of the Beimbet Mailin District " has the right to act as a party to civil law relations on behalf of the state, if it is authorized to do so in accordance with the law. 7. The state institution "Department of Architecture, Urban Planning and Construction of the Akimat of the Beimbet Mailin District " on issues of its competence in the manner prescribed by law makes decisions, formalized by orders of the head of the state institution and other acts provided for by the legislation of the Republic of Kazakhstan. 8. The structure and staffing limit of the state institution "Department of Architecture, Urban Planning and Construction of the Akimat of the Beimbet Mailin District " are approved in accordance with the current legislation. 9. Full name of the public body: the state language " Beyіmbet Myleene Auda әkіmdіgіnіңsәulet , қala құrylysy zhane Qurylys блімі " memlekettіk mekemesі " in Russian state institution "Department of architecture, urban planning and construction of the Akimat of the district of Beimbet Mailin ". In the state institution "Department of Architecture, Urban Planning and Construction of the Akimat of Beimbet Mailin District " the working hours are set from 9:00 to 18:30 daily (except Saturday and Sunday), with a break for rest and eating from 13:00 to 14:30. 11. This Regulation is a constituent document of the state institution "Department of Architecture, Urban Planning and Construction of the Akimat of the Beimbet Mailin District ". 12. Financing of the activities of the state institution "Department of Architecture, Urban Planning and Construction of the Akimat of the Beimbet Mailin District " is carried out from the local budget. 13. The state institution "Department of Architecture, Urban Planning and Construction of the Akimat of Beimbet Mailin District " is prohibited from entering into contractual relations with business entities for the performance of duties that are the functions of the state institution "Department of Architecture, Urban Planning and Construction of the Akimat of Beimbet Mailin District ". If the state institution "Department of Architecture, Urban Planning and Construction of the Akimat of Beimbet Mailin District " is granted the right to carry out income-generating activities by legislative acts , then the income received from such activities is directed to the state budget.
2. Mission, main tasks, functions, rights
and obligations of the state body
- The mission of the state institution "Department of Architecture, Urban Planning and Construction of the Akimat of Beimbet Mailin District " is to carry out the functions of state administration in the field of architecture, urban planning and construction. 15. Objectives: 1) implementation of state policy in the field of architecture, urban planning and construction in the district; 2) implementation, within its competence, of state regulation of architectural, urban planning and construction activities on the territory of the district; 3) improving the quality of the provision of public services; 4) monitoring legislation to identify and / or exclude public services, change the name of public services that are within the competence of the state body; 5) ensuring the formation of social, engineering infrastructure of settlements and territories; 6) implementation of public procurement in areas falling within the competence, participation in the construction and reconstruction of industrial, housing and social facilities; 7) other tasks provided by the legislation of the Republic of Kazakhstan. 16. Functions: 1) monitoring of objects and complexes under construction (planned for construction); 2) organization of work on maintaining the state urban planning cadastre of the basic level; 3) development of proposals for making changes and / or additions to the Register of public services rendered to individuals and legal entities, in terms of public services that are within the competence of the state body; 4) issuance of architectural and planning assignments; 5) issuance of permits for the placement of outdoor (visual) advertising objects in settlements; 6) issuance of certificates for determining the address of real estate objects in the territory of the Republic of Kazakhstan; 7) selection of land plots for the construction of facilities; 8) approval of draft (working) projects; 9) analysis, adjustment and assistance in the implementation of priority programs for the development of the construction of the district; 10) control over the progress of construction and reconstruction of facilities; 11) assistance in the development of a competitive market in the field of construction; 12) taking part in tenders for the construction and reconstruction of district facilities; 13) acceptance of completed work on the construction and reconstruction of facilities in accordance with the regulatory and technical and design documentation; 14) ensuring effective spending of budgetary funds and material assets in accordance with the intended purpose; 15) preparation of applications and certificates for amendments to financing plans for budget programs; 16) control of the timely transfer of funds under concluded civil transactions; 17) development of action plans for the implementation of regional programs, orders of higher state bodies within the competence of the department; 18) preparation of operational information, certificates, reports on supervised issues; 19) forecasting data on the development of engineering and communication infrastructure, construction of district facilities; 20) work on appeals of individuals and legal entities and the formation of a report form 1-OL "On consideration of appeals of individuals and legal entities"; 21) performing other functions in accordance with the legislation of the Republic of Kazakhstan; 22) solution of other issues in the field of architectural, urban planning and construction activities within the powers established by the legislative acts of the Republic of Kazakhstan. 17. Rights and obligations: 1) keep records and control over the passage, execution of documents submitted to the state institution "Department of Architecture, Urban Planning and Construction of the Akimat of the Beimbet Mailin District ", preparation of information on the progress of their execution; 2) request from all subjects in the field of architectural, urban planning and construction activities documents, conclusions, reference and other materials necessary for the implementation of the functions assigned to the state institution "Department of Architecture, Urban Planning and Construction of the Akimat of the Beimbet Mailin District "; 3) ensure the availability of regulations for the provision of public services; 4) ensure consumer awareness of the procedure for the provision of public services; 5) consider complaints and proposals of consumers of public services; 6) request and receive in the prescribed manner from institutions, organizations, enterprises located on the territory of the district, regardless of their departmental affiliation and form of ownership, akim's offices of rural districts, information necessary to perform the tasks and functions assigned to the department; 7) within the limits of their competence, issue legal acts; 8) submit for consideration by the akim, akimat of the region and the regional maslikhat proposals on resolving issues related to their competence; 9) conclude contracts for the construction, reconstruction of district facilities; 10) analyze the activities of institutions, enterprises and organizations on issues within the competence of the department, give the necessary proposals for improving the work; 11) to convene, in agreement with the supervising deputy akim of the district, meetings on issues within the competence of the department; 12) conduct negotiations and sign agreements, other legal acts on issues of their competence; 13) to attract specialists from enterprises, organizations, public formations of the region, in agreement with their head, for conducting inspections, examinations, participation in competition commissions; 14) exercise other rights and obligations in accordance with the legislation of the Republic of Kazakhstan.
- Organization of activities of a state body
- The management of the state institution "Department of Architecture, Urban Planning and Construction of the Akimat of the Beimbet Mailin District " is carried out by the head, who is personally responsible for the implementation of the tasks assigned to the state institution and the implementation of its functions. The mode of operation of a state institution, working hours and labor relations are regulated in accordance with the labor legislation of the Republic of Kazakhstan. 19. The head of the state institution "Department of Architecture, Urban Planning and Construction of the Akimat of the Beimbet Mailin District " is appointed and dismissed in accordance with the current legislation of the Republic of Kazakhstan. 20. The head of the state institution "Department of Architecture, Urban Planning and Construction of the Akimat of the Beimbet Mailin District " has no deputies. 21. Powers of the head: 1) organizes and manages the work of the state institution "Department of Architecture, Urban Planning and Construction of the Akimat of the Beimbet Mailin District " and bears personal responsibility for the implementation of the functions and tasks assigned to him, as well as for failure to take measures to combat corruption; 2) appoints and dismisses employees in accordance with the procedure established by law; 3) defines the powers and obligations of employees; 4) approves job descriptions; 5) issues orders and gives instructions that are binding on employees , signs service documentation; 6) represents a state body in state bodies and other organizations in accordance with the current legislation; 7) in accordance with the procedure established by legislation, decides the issues of imposing disciplinary sanctions, incentives and the provision of material assistance within the limits of saving the wage fund; 8) conducts a personal reception of citizens and representatives of legal entities, considers applications of individuals and legal entities within the time frame established by law, takes the necessary measures on them; 10) implements gender policy within its competence; 11) exercise other powers in accordance with the legislation of the Republic of Kazakhstan on issues within its competence, and in accordance with the job description. The execution of the powers of the head of the state institution "Department of Architecture, Urban Planning and Construction of the Akimat of Beimbet Mailin District " during his absence is carried out by the person replacing him in accordance with the current legislation.
- Property of a state body
- The state institution "Department of Architecture, Urban Planning and Construction of the Akimat of Beimbet Mailin District " may have separate property on the basis of operational management in cases stipulated by law. The property of the state institution "Department of Architecture, Urban Planning and Construction of the Akimat of the Beimbet Mailin District " is formed at the expense of the property transferred to it by the owner, as well as property (including cash income) acquired as a result of its own activities and other sources not prohibited by the legislation of the Republic of Kazakhstan. 23. The property assigned to the state institution "Department of Architecture, Urban Planning and Construction of the Akimat of the Beimbet Mailin District " refers to communal property. 24. The state institution "Department of Architecture, Urban Planning and Construction of the Akimat of the Beimbet Mailin District " is not entitled to independently alienate or otherwise dispose of the property assigned to it and property acquired from the funds issued to it under the financing plan, unless otherwise provided by law.
- Reorganization and abolition of the state body
- Reorganization and abolition of the state institution "Department of Architecture, Urban Planning and Construction of the Akimat of the Beimbet Mailin District " is carried out in accordance with the legislation of the Republic of Kazakhstan.
