ANALYTICAL REFERENCE according to the results of an internal analysis of corruption risks in the activities of the State Institution "Akim's Office of the Maysky Rural District" for the period from January 01 to August 31, 2021.       

In the State Institution "Office of the akim of the Maysky rural district", a working group consisting of: Akim of the Maysky rural district S. V. Endorenko, chief specialist L. A. Ekimova conducted an internal analysis of corruption risks in the activities of the State Institution "Office of the Akim of the Maysky Rural District" for the period from January 01 to August 31, 2021.

The internal analysis was carried out in accordance with the Law of the Republic of Kazakhstan dated 18.11.2015 "On Combating Corruption" No. 410-V of the ZRK, as well as the Rules for conducting internal Analysis of Corruption Risks, approved by the order of the Chairman of the Agency of the Republic of Kazakhstan for Civil Service Affairs and Anti-Corruption dated 19.10.2016 No. 12, on the basis of the order of the akim of the Maysky rural district dated February 10, 2021 No. 13.

The State Institution "Office of the Akim of the Maysky Rural District" in its activities is guided by the Constitution of the Republic of Kazakhstan, the Laws of the Republic of Kazakhstan "On Public Service", "On Local Public Administration and Self-Government in the Republic of Kazakhstan", "On Combating Corruption", "On public Services", the Administrative Procedural Code of the Republic of Kazakhstan", "On Public Procurement", also follows the Budget, Civil, Codes of the Republic of Kazakhstan, the Code of the Republic of Kazakhstan "On Administrative Offenses", "Rules of Public Procurement", other regulatory legal acts of the Republic of Kazakhstan and the regulations of the state institution "Office of the Akim of the Maysky Rural District".

Identification of corruption risks in regulatory legal acts in the activities of the state institution "Akim's Office of the May rural District". During the reporting period, the akimat of the May rural District adopted 6 decisions, issued 111 orders. The analysis of legal acts and norms did not reveal discretionary powers that contribute to the commission of corruption offenses.

Identification of corruption risks in the organizational and managerial activities of the state institution "Akim's Office of the May rural District".

Personnel management, including the turnover of personnel. According to the staffing of the state institution "The Office of the akim of the May rural District", there are 5 civil servants. The actual number of civil servants for the reporting period 6 . According to the Decree of the akim of the district of Beimbet Maylin No. 174 dated August 12, 2021, 1 unit was excluded from the state of the State Institution "Apparatus of the akim of the Maysky rural District"

During the reporting period, the number of civil servants employed was 2. During the reporting period, the number of dismissed civil servants-1

Civil servants were not involved in disciplinary actions during the period under review. All civil servants meet the qualification requirements. In the reporting period, there were no facts of acceptance and joint work with relatives.

   Information about illegal and illegal actions of state employees of the akim's office has not been published in the mass media. Conflict of interest

During the internal analysis of corruption risks, there are no conflicting interests in the activities of the State Institution "Akim's Office of the May Rural District".

  Provision of public services

Functions for the provision of public services:

  1. Registration of changes in the name, patronymic, surname, including making changes, additions and corrections to the civil status records
  2. Registration of death, including making changes, additions and corrections to the civil status records
  3. Restoration of civil status records
  4. Cancellation of civil status records
  5. Registration of marriage (matrimony), including making changes, additions and corrections to the civil status records
  6. Registration of the dissolution of marriage( matrimony), including making changes, additions and corrections to the civil status records
  7. Registration of the birth of a child, including making changes, additions and corrections to the civil status records
  8. Appointment of state targeted social assistance
  9. Assignment of social assistance to certain categories of needy citizens by decisions of local representative bodies
  10. Issuing a decision to change the purpose of the land plot
  11. Provision of a land plot for the construction of an object within the settlement
  12. Acquisition of rights to land plots that are in state ownership, which does not require bidding (contests, auctions)
  13. Sale of a land plot to private ownership at a time or in installments
  14. Placing on the waiting list for receiving a land plot

According to the results of the analysis , there is a corruption risk in the provision of public services, but for the specified period there are no facts of detecting corruption offenses in the State Institution "Akim's Office of the May Rural District".

Appeals of individuals and legal entities received by the State Institution "Office of the akim of the Maysky rural district"

According to the requests of individuals and legal entities:

    The work in the State Institution "Office of the Akim of the Maysky Rural District" on citizens ' appeals is carried out in accordance with the Law of the Republic of Kazakhstan "On the procedure for considering appeals of individuals and legal entities" dated January 13, 2007 No. 221, the Administrative Procedural and Procedural Code of the Republic of Kazakhstan"

The analysis of the state of work, ensuring the timeliness and quality of consideration of appeals of individuals and legal entities, measures are being taken to increase control, not allowing consideration of appeals in violation of the established deadlines.

For the period from January 01 to August 31, 2021, 11 appeals were accepted, 11 appeals were considered, 8 were satisfied, 3 were explained.

Public procurement

The analysis of public procurement conducted in the akim's office is carried out. The Akim's office develops and approves an annual public procurement plan in the order and form determined by the rules of public procurement. Changes are made to the annual public procurement plan on a monthly basis. The procedure for conducting public procurement is transparent and accessible to all potential suppliers through state information systems. Public procurement takes place in electronic form, which minimizes collusion between suppliers and customers, helps to reduce the level of misuse of budget funds. For the period from January 01 to August 31, 2021, 37 contracts were concluded, of which 32 contracts were concluded from one source by direct conclusion of a contract, 4 contracts were concluded by request for price proposals, 1 contract was concluded from one source for failed purchases. There is a corruption risk in this type of activity, but for the specified period there are no facts of detecting corruption offenses in the State Institution "Akim's Office of the May Rural District".

  Acts of prosecutor's response:

There were no submissions from the district Prosecutor's office.

Judicial acts (number, on what issues)

On 15.04.2021, a private definition of the CMES of the Kostanay region was received, the identified offenses provide for a corruption risk, but they do not have facts of a corruption offense.

Other issues identified during the analysis:

There were no critical publications in the mass media.

Proposals for improving the anti-corruption measures taken:

In order to reduce corruption risks, it is necessary to continue working on the internal analysis of corruption risks in the activities of the akim's office of the May rural district, observing the basic principles of anti-corruption in accordance with the Law of the Republic of Kazakhstan "On Anti-Corruption".
