The Committee for State Revenues of the Ministry of Finance of the Republic of Kazakhstan has introduced amendments and additions to the Rules for Completing the Tax Reporting Form “Calculation of Corporate Income Tax Withheld at Source on Income Paid to Non-Residents (Form 101.04)”. These amendments were approved by Order No. 1332 of the Deputy Prime Minister – Minister of Finance dated December 28, 2023, and Order No. 783 of the Minister of Finance dated November 25, 2024.
The revised version came into effect on January 1, 2024, and aims to strengthen control over the justified application of tax benefits by tax agents as provided by the Tax Code.
Key updates:
- Form 101.04 must now include income not subject to taxation under the Tax Code.
- It must also reflect payments not considered as income from sources within Kazakhstan.
To reduce the administrative burden, these amounts are only required to be reported if they exceed a total threshold of USD 50,000 per calendar year (from January 1 to December 31). Currency conversion is carried out in accordance with Article 647 of the Tax Code.
The implemented changes aim to enhance the quality of reporting and reduce the number of notifications sent by tax authorities.
