Procedure for submitting a Declaration of assets and liabilities

According to paragraph 1 of article 632 of the Tax code, unless otherwise provided by paragraph 2 of this article, the Declaration is submitted at the place of residence (stay):

1) in case of paper submission – no later than July 15 of the current year, in which the obligation to submit the Declaration arose;

2) in case of submission in electronic form – no later than September 15 of the current year, in which the obligation to submit the Declaration arose.

The provisions of part one of this paragraph regarding the timing of the submission of the Declaration do not apply to persons who submit the Declaration as:

candidates for elected positions in accordance with the election Law and the anti-corruption Law;

individuals who want to become major participants in a Bank, insurance (reinsurance) organization, or investment portfolio Manager in accordance with the Laws on banks, insurance activities, and the securities market.

On the basis of paragraph 2 of article 11 of the anti-corruption Law, candidates and their spouses submit a Declaration before registering as a candidate and reflect information on the first day of the month of the start of the nomination period.

Persons wishing to become a major participants of the Bank, insurance (reinsurance) organizations, investment portfolio Manager submit a Declaration before the date of filing to the authorized body statements about the acquisition of status of large participant of the Bank, the status of the large participant of insurance (reinsurance) organization, a status of large participant of managing investment portfolio. Information in the Declaration shall specify the first day of the month of submission of the Declaration (paragraph 3-3) of paragraph 4 of article 17-1 of the Law on banks, paragraph 6) of paragraph 6 of article 26 of the Law on insurance business, subparagraph 6) of paragraph 6 of article 72-1 of the Law on securities market).

Thus, if an individual as of January 1, 2021 was a person holding a responsible state position, a person authorized to perform state functions, a person equated to persons authorized to perform state functions, or a spouse of these persons, then he or she has obligations to submit a Declaration no later than July 15 in hard copy or September 15 in electronic form. It should be noted that the information in the Declaration by these persons is reflected as of December 31, 2020.

If an individual is a candidate in accordance with the laws on elections and anti-corruption, then such person and his / her spouse submit a Declaration before registering as a candidate and provide information on the first day of the month when the nomination period begins.

A person who wants to become a major participant in a Bank, insurance (reinsurance) organization, or investment portfolio Manager in accordance with the Laws on banks, insurance activities, and the securities market, shall submit a Declaration before the date of filing with the authorized body of an application to acquire such status, reflecting information on the first day of the month of submission of this Declaration.
