Regarding persons submitting a Declaration of assets and liabilities

The state revenue Committee of the Ministry of Finance of the Republic of Kazakhstan informs that in accordance with the Law of the Republic of Kazakhstan dated December 25, 2017 No. 121-VI "On introduction of the code of the Republic of Kazakhstan "On taxes and other obligatory payments to the budget" (Tax code) (further – the Law) from 1 January 2021 shall be enforced Chapter 71 of the Code of the Republic of Kazakhstan "On taxes and other obligatory payments to the budget" (Tax code) "Universal Declaration".

Under article 45-1 of the Law of the universal Declaration is being introduced in stages.

Subparagraph 1) of article 45-1 of the Law establishes that from January 1, 2021 (stage 1), the Declaration of assets and liabilities (hereinafter – the Declaration) is submitted by the following individuals who are on January 1 of the year of submission of the Declaration:

persons holding a responsible public position and their spouses;

persons authorized to perform state functions and their spouses;

persons equated to persons authorized to perform state functions and their spouses;

the persons entrusted with the obligation to submit Declaration in accordance with the Constitutional law of the Republic of Kazakhstan "On elections in the Republic of Kazakhstan" and laws of the Republic of Kazakhstan "On combating corruption", "On banks and banking activities in the Republic of Kazakhstan", "On insurance activity", "On securities market" (hereinafter – the Law on elections, the Law on combating corruption, the Law on banks, Law on insurance activities, Law on securities market).

Thus, according to article 1 of the anti-corruption Law:

a person holding a responsible state post, – it is the person holding the office established by the Constitution of the Republic of Kazakhstan, constitutional and other laws of the Republic of Kazakhstan for the direct execution of state functions and powers of state bodies, including the Deputy of Parliament of the Republic of Kazakhstan, the judge, or the person holding under the law of the Republic of Kazakhstan on public service political public office or administrative state position of corps "A»;

a person authorized to perform state functions is a civil servant in accordance with the laws of the Republic of Kazakhstan on public service, a Deputy of the maslikhat, as well as a person who temporarily performs the duties provided for by the state position, before being appointed to the state service;

a person equated to persons authorized to perform state functions is a person elected to local self-government bodies; a citizen registered in accordance with the law of the Republic of Kazakhstan as a candidate for President of the Republic of Kazakhstan, deputies of the Parliament of the Republic of Kazakhstan or maslikhats, mayors of cities of district significance, settlements, villages, rural districts, as well as members of an elected local self-government body; an employee who permanently or temporarily works in a local self-government body, whose remuneration is made from the state budget of the Republic of Kazakhstan; a person who performs managerial functions in a state organization or a quasi-public sector entity, employees of the National Bank of the Republic of Kazakhstan and its departments; employees of an authorized organization in the field of civil aviation acting in accordance with the legislation of the Republic of Kazakhstan on the use of the airspace of the Republic of Kazakhstan and aviation activities, employees of the authorized body for regulation, control and supervision of the financial market and financial organizations (subparagraph 4) of article 1 of the anti-corruption Law).

Persons who are required to submit a Declaration in accordance with the law:

about elections-candidates for President of the Republic of Kazakhstan (paragraph 2 of article 59), for deputies of the Senate (paragraph 2 of article 73) and the Mazhilis (article 89, paragraph 2) The Parliament of the Republic of Kazakhstan and members of local self-government bodies (article 118, paragraph 1-1) Of the Republic of Kazakhstan (hereinafter-the candidate), as well as the spouses of these persons;

on anti-corruption-candidates for President of the Republic of Kazakhstan, for deputies of the Parliament of the Republic of Kazakhstan and maslikhats, for mayors of cities of district significance, settlements, villages, rural districts, as well as for members of elected local self-government bodies and their spouses (paragraph 2 of article 11);

about banking activities-persons wishing to acquire the status of a major Bank participant (sub-item 3-3) article 17-1, paragraph 4).

about insurance activity-persons wishing to acquire the status of a major participant in an insurance (reinsurance) organization (sub-item 6) of paragraph 6 of article 26).

on the securities market-persons wishing to acquire the status of a major participant in an investment portfolio Manager (sub-paragraph 6) of paragraph 6 of article 72-1).
