Press Release to the draft order of the Deputy Prime Minister - Minister of Finance of the Republic of Kazakhstan “On introducing amendments and additions to the order of the Minister of Finance of the Republic of Kazakhstan dated March 19, 2018 № 391 “On approval of the Rules for the return of excess value added tax and the application of a risk management system in in order to confirm the reliability of the amount of excess value added tax, as well as the criteria for the degree of risk"

The State Revenue Committee has developed a draft regulatory legal act as part of the measures taken to implement the instructions of the Head of State, voiced at the annual Address of September 1, 2023 “Economic Course of a Fair Kazakhstan”, in particular to simplify the VAT refund procedure.

The development took into account comments and suggestions from the business community, which were discussed within the Working Group on Improving Tax and Customs Administration together with the Association of Taxpayers of Kazakhstan and NCE Atameken.

The draft legal regulations provide for the optimization of the refund of excess VAT by revising the principles for determining the conditions for generating the analytical report “Pyramid” for direct suppliers, the amount of excess VAT subject to refund when violations are established for certain categories of taxpayers, and also identifying risk factors for suppliers using tax evasion schemes.

The draft legal acts on December 29, 2023 are posted on the website legalacts.egov.kz for public discussion.
