In order to implement the second, third, fourth, fifth, seventh, ninth, tenth, eleventh, twelfth, thirteenth, and fourteenth paragraphs of subparagraphs 17), 18), 21), and 24) of paragraph 2 of Article 55 of the Tax Code of the Republic of Kazakhstan, which enters into force on January 1, 2026, the Order of the Minister of Finance of the Republic of Kazakhstan No. 698 dated November 12, 2025, was adopted. The Order is titled: “On approval of the forms for submission by banking organizations to the state revenue authority of information on the availability and numbers of bank accounts of individuals and legal entities, on balances and movement of funds on such accounts, on loans issued to an individual who has incurred an obligation to submit declarations on assets and liabilities, income and property, the Rules and deadlines for submitting information on taxpayers engaged in electronic trade of goods, as well as the List and Rules for submitting information on the total amount of money credited to an individual’s bank account that indicates potential income from entrepreneurial activity, and the criteria for classifying such operations” (hereinafter – the Order).
A key innovation of the Order is the introduction of a threshold for classifying transactions on bank accounts of individuals as operations indicating potential income from entrepreneurial activity.
Previously, the criterion was based solely on the number of incoming transfers — 100 or more different individuals within three consecutive calendar months. The new version supplements this with an additional condition: the total amount of incoming transfers for the same period must exceed twelve times the minimum monthly wage effective as of January 1 of the corresponding financial year.
Thus, the criteria include receipt by an individual, within each of three consecutive calendar months, of money from 100 or more different individuals into a bank account (or accounts) not intended for entrepreneurial activity, where the total amount of such incoming funds for the specified period exceeds twelve times the minimum monthly wage established by the law on the republican budget and effective as of January 1 of the respective financial year.
