in state revenue bodies»

Corruption is one of the major and most dangerous challenges to human development. It not only puts the sovereignty and security of the State at risk, but also betrays the principles of human civilization. It disrupts normal development of all aspects of people's lives, lowers their morale and material well–being, and also deepens one of the most dangerous crises for normal human life and business - the crisis of confidence.

On February 2, 2022, the “Concept of the anti-corruption policy of the Republic of Kazakhstan for 2022-2026” was approved by the Decree of the President of the Republic of Kazakhstan No. 80.

In this regard, Kazakhstan's anti-corruption policy improves constantly depending on the current demands of the society, taking into account national practice and the best foreign practices.

There is currently a ban on employment in the public service for persons who have committed crimes of corruption, sanctions are upgraded for corruption crimes for bribe givers and intermediaries in.

Institute of personal responsibility of heads of state bodies, organizations, quasi-public sector entities for corruption of subordinates has been introduced.

On January 3, 2023, the Head of State signed the Law "On Amendments and additions to some legislative acts of the Republic of Kazakhstan on combating corruption and ensuring the safety of persons subject to state protection"

The adopted amendments are aimed at further improving the anti-corruption legislation, including through the introduction of new aspects to prevent corruption, filling legal gaps.

  1. Responsibility for unjust enrichment is introduced through monitoring compliance of expenses and revenue of civil servants, as well as equivalent persons.

Fiscal and career sanctions will be applied for the mismatch between revenue expenditure of officials based on the results of the comparison of declarations.

In each case, the civil servant will be given the opportunity to confirm the legality of expenditures.

If he is not able, then it entails administrative liability in the form of a fine in the amount of 90% of the amount of the total difference. With a significant discrepancy, namely exceeding the annual revenue of an official, in addition to a fine, he is subject to the dismissal on adverse grounds.

Establishing facts of unjust enrichment is entrusted to the state revenue bodies within the framework of cameral control.

The norms will apply to civil servants, persons equated to them and their spouses.

Timing for the introduction of this innovations is set for 2027, taking into account the full coverage of the population by universal declaration.

It should be noted that the introduction of liability for unjust enrichment is one of the requirements of the UN Convention against Corruption, ratified by Kazakhstan in 2008.

  1. Measures to protect persons who reported a crime related to corruption have been strengthened. The amendments are aimed at protecting the labor rights of such persons.

These persons are not subject to disciplinary responsibility, they cannot be dismissed or transferred to another position without the recommendations of the disciplinary commission or other collegial body.

At the same time, a state body or organization will be committed to inviting a representative of the anti-corruption service to participate in a meeting of the collegial body.

Measures to protect confidential information on these persons will be strengthened as well by criminalizing the disclosure of such information.

In order to implement legislative acts and management decisions in the field of combating corruption, create conditions that prevent the possibility of corrupt behavior and ensure the corruption level reduction in the system of state revenue bodies, tax and customs systems are being digitalized.

The information system "Astana-1", "Electronic invoices", module "Labeling of goods", online CRM have been developed and operate.

Corruption and its manifestation reduce a person's confidence in state bodies and in justice as a whole. Indeed, everyone is convinced that the world is arranged harmoniously and everyone in life gets what it deserves by its personality and behavior.

Not only civil servants, but also all members of society must participate in compliance with anti-corruption legislation, it is a two-way process in which officials and entrepreneurs must participate.
