Conflict of interest in the civil service

Conflict of interest in the civil service

The concept of conflict of interest is defined by subparagraph 17 of paragraph 1 of Article 1 of the Law of the Republic of Kazakhstan "On Civil Service of the Republic of Kazakhstan" dated November 23, 2015 No. 416-V, as "a contradiction between the personal interests of a civil servant and his official powers, in which the personal interests of a civil servant may lead to non-performance or improper performance of their official duties."

A similar definition of conflict of interest in the civil service is given by the Law of the Republic of Kazakhstan "On Combating Corruption" dated November 18, 2015 No. 41-V, and the provisions of this law related to the observance by civil servants of prohibitions and restrictions, the requirement to resolve conflicts of interest, are extended to all types of civil service.

At the same time, the procedure for resolving a conflict of interest in the civil service consists in the fact that a civil servant is obliged to notify his immediate supervisor or the management of a state body in writing about the conflict of interest that has arisen or about the possibility of its occurrence as soon as they become aware of it.

Prevention or resolution of a conflict of interests on the part of a civil servant is carried out by his / her self – recusal, and on the part of the management of a state body-by suspension from performance, or by changing the official duties of a civil servant, or by other measures to eliminate a conflict of interests.

At the same time, the deliberate failure of a civil servant who is a party to a conflict of interest to take measures to prevent and resolve a conflict of interest is recognized as a disciplinary offense. A civil servant, his / her direct supervisor and the management of a state body bear disciplinary responsibility for failure to take measures to prevent and resolve cases of conflict of interest known to them.

In the state revenue bodies of the West Kazakhstan region, the procedure for reporting by civil servants on the occurrence of personal interest in the performance of official duties, which leads or may lead to a conflict of interests, is defined by the order of the Department dated 20.04.2017 No. 173-B "On measures to prevent and resolve conflicts of interest", according to which:
