Explanation of the norm of temporary importation of foreign vehicles
The State Revenue Department for the Zhambyl region notifies the population and explains the norms of the customs legislation of the Republic of Kazakhstan on vehicles for personal use, which are registered in a state that is not a member of the Eurasian Economic Union (EAEU).
In accordance with Article 347 of the Code of the Republic of Kazakhstan “On Customs Regulation in the Republic of Kazakhstan”, temporary importation into the customs territory of the Eurasian Economic Union by foreign individuals of vehicles for personal use, registered in a state that is not a member of the Eurasian Economic Union, is allowed for a period of not more than one year.
Temporarily imported vehicles for personal use must be in the customs territory of the Eurasian Economic Union in the actual possession and use of the declarant. Cases of transfer of such vehicles to other persons are defined by Article 347 of the Code.
In the event that the facts of the transfer of temporarily imported vehicles for personal use contrary to the rules established by Article 347 of the Code are revealed, before their customs declaration for the purpose of free circulation, such vehicles are detained by the customs authorities in accordance with Chapter 52 of the Code for 30 days. We draw your attention to the fact that at present there are more cases of illegal driving by citizens of Kazakhstan of such vehicles registered in the states of Georgia, Abkhazia, South Ossetia, etc., previously temporarily imported by foreign persons according to passenger customs declarations with an obligation in restrictions on the duration of stay on the territory of the EAEU and transfer to other persons.
In cases of detection of facts of illegal transfer by foreign persons of temporarily imported vehicles not registered in the EAEU states, citizens of Kazakhstan and individuals of the EAEU have a joint and several obligation to pay customs duties and taxes from persons in whose possession this vehicle was at the time of detention by the police and authorities government revenue.
