Completion and termination of the customs transit procedure

In accordance with Article 231 of the Code of the Republic of Kazakhstan "On Customs Regulation in the Republic of Kazakhstan" (hereinafter - the Code), the customs transit procedure ends after the delivery of goods to the place of delivery of goods determined by the customs authority of departure.

At the place of delivery of goods, until the completion of the customs transit procedure, goods are placed in the customs control zone, including without off-loading the goods from the vehicle used for their delivery.

Goods are placed in the customs control zone at any time of the day.

In order to complete the customs transit procedure , the carrier or the declarant of goods placed under the customs procedure of customs transit is obliged to submit a transit declaration to the customs authority of destination , as well as other available  documents in respect of goods transported:

1) road transport – within three hours from the moment of their arrival at the place of delivery of goods, and in the case of arrival of goods outside the working hours of the customs authority – within three hours from the onset of thethe daily opening hours of this customs authority;

2) with the use of water, air or rail transport, – during the time established by the technological process (schedule) of the port, airport or railway station when carrying out international transportation, but no later than the end of the next working day of the customs body of destination from the moment of arrival of the vehicle at the place of delivery of goods.

On behalf of the carrier, in order to complete the above actions of the customs transit procedure, actions may be performed by persons acting on behalf of such a carrier.

At the request of the customs authority, the carrier is obliged to present the goods.

The customs body of destination registers the submission of documents in accordance with the procedure established by the authorized body within one hour from the moment of submission of the documents.

The customs body of destination completes the customs procedure of customs transit at the earliest possible date, but no later than four hours of the working time of the customs body from the moment of registration of the submission of documents, and if the submission of the documents is registered less than four hours before the end of the working time of the customs body– within four hours from the beginning of the working time of this customs body.

 In the case of customs body’s decision to conduct a customs inspection, the term of completion of the customs transit procedure with the written permission of the head of the customs body of destination, the deputy head of the customs body of destination  or substitute persons , may be extended for the time required for customs inspection, but not more than five working days from the day following the day of registration of the submission of documents.

The completion of the customs transit procedure is executed using the information system of the customs authority by forming an electronic document or by affixing appropriate marks on the transit declaration or other documents used as a transit declaration.

The procedure for performing customs operations related to the completion of the customs transit procedure, including those that depend on the type of transport by which the goods are transported (moved), is determined by the Commission.

Cases when the customs transit procedure completes with the placement of goods for temporary storage, the release of goods, as well as the procedure for performing customs operations related to the completion of the customs transit procedure, including - depending on the type of transport, are approved by the authorized body.

The procedure for performing customs operations related to the termination of the customs transit procedure, time frames within which the customs transit procedure is subject to termination, as well as the procedure for processing the termination of the customs transit procedure are determined by the Commission.

Upon delivery of goods to the customs control zone established in facilities, premises (parts of premises) and (or) on open areas (parts of open areas) of an authorized economic operator with certificates of the second or third type, the customs transit procedure is completed with the features established by this Code.
