Actions to enforce recovery of tax debts

Authorized body shall:     

1) maintain the register of notifications of persons entitled to carry out the activity of an administrator;   

1-1) appoint a person, selected by a creditor for taxes and customs payments, a state body or a legal entity partially owned by the state, as an interim manager; 

2) appoint candidacy to the rehabilitation or bankruptcy managers nominated by the creditors’ meeting;     

3) dismiss rehabilitation and bankruptcy managers;    

4) exercise state control over compliance with the legislation of the Republic of Kazakhstan on rehabilitation and bankruptcy;

In the recovery of  tax debts of a taxpayer, the state revenue authorities apply measures to enforce recovery of tax debts of a taxpayer - a legal entity, a structural subdivision of a legal entity, a non-resident working in the Republic of Kazakhstan through a permanent establishment, an individual entrepreneur, or a person engaged in private practice.

For enforcement of tax debts following procedure shall be used:

1) at expense of money in bank accounts;

2) from debtors ' accounts;

3) at the expense of sale of property that is limited in its disposal;

4) in the form of a compulsory issue of the declared shares.
