Rules for the provision of public services «Inclusion in the register of owners of warehouses for the storage of their own goods»
Chapter 1. General provisions
(hereinafter referred to as the service recipient).
Chapter 2. Procedure for the provision of public services
1) through the non-profit joint-stock company " State Corporation "Government for Citizens "(hereinafter-the State Corporation);
2) through the e-government web portal www.egov.kz (hereinafter-the portal).
A list of the main requirements for the provision of public services, including the characteristics of the process, form, content and result of the provision, as well as other data with the features of the provision of public services set out in accordance with Annex 1 in the form of standard of the state service.
When applying in electronic form-the application in the form of an electronic document certified by the EDS of the service recipient is accepted through the portal.
To receive the state service, the service recipients provide documents in accordance with Article 166 of the Code of the Republic of Kazakhstan "On Customs Regulation in the Republic of Kazakhstan" dated December 26, 2017
(hereinafter referred to as the Customs Code).
To identify the identity of the service recipient, an identity document is presented.
When providing a public service, the service recipient provides consent to the use of information that constitutes a legally protected secret contained in information systems, unless otherwise provided by the laws of the Republic of Kazakhstan.
Information about the identity documents contained in the state information systems, the service provider and (or) the employee of the State Corporation receives from the relevant state information systems through the portal in the form of electronic documents certified by an electronic digital signature (hereinafter-EDS) of authorized officials.
It is not allowed to request documents and information that can be obtained from information systems from service recipients.
When applying to a State Corporation, if the service recipient provides an incomplete package of documents in accordance with the list provided for in paragraph 8 of Annex 1 to these Rules, as well as documents with expired validity, the employee of the State Corporation refuses to accept the application, and issues a receipt for refusal to accept documents in accordance with Annex 2 to these Rules.
When you receive documents through the State Corporation, the applicant shall be issued a receipt on submission of relevant documents.
When providing a public service through a State Corporation on paper, the day of receipt of applications and documents is not included in the term of rendering the public service.
In the case of an application through the portal, the service recipient is sent a status of acceptance of the request for the provision of public services.
When the service recipient submits documents to the State Corporation in an appearance order-an employee of the State Corporation accepts, checks the documents submitted by the service recipient, and sends the accepted documents to the service provider via courier communication.
The structural division of the service provider responsible for receiving documents on the day of receipt of documents receives, checks the submitted documents and registers (when the service recipient applies after the end of working hours, on weekends and holidays, according to the Labor Code of the Republic of Kazakhstan dated November 23, 2015, applications are accepted and the results of the provision of public services are issued on the next working day).
In cases where the service recipient submits an incomplete set of documents, according to the list provided for in Article 166 of the Customs Code, and (or) documents with expired validity, the service provider refuses to accept the application.
If the fact of completeness of the submitted documents is established, the employee responsible for processing considers the application within 10 (ten) working days from the date of its registration.
An official of the service provider performs a customs inspection of the applicant's premises and territories in accordance with Article 415 of the Customs Code for compliance with the requirements specified in paragraph 3 of Article 165 of the Customs Code.
When conducting a customs inspection of premises and territories, the service recipient submits to the official of the service provider copies of documents confirming compliance with the requirements specified in paragraph 3 of Article 165 of the Customs Code.
At the same time, copies of the submitted documents are attached to the act of customs inspection of the premises and territories, which remains with the service provider.
The decision on inclusion in the register of owners of warehouses of storage of own goods is made out by the order of the head, the service provider or the person replacing him, or the deputy head of the service provider.
The service provider notifies the service recipient in writing or electronically.
In accordance with subparagraph 11) of paragraph 2 of article 5 of the law of the service provider provides insertion of data into the information system of monitoring of public services on the stage of rendering the state service in the manner prescribed by order of the acting Minister of transport and communications of the Republic of Kazakhstan dated June 14, 2013, № 452 "On approval of the Rules for entering data into the information system of monitoring of public services on the stage of rendering of the state services" (registered in the Register of state registration of regulatory legal acts under No. 8555).
When accessing the portal, the result of the provision of public services is sent to the service recipient in the form of an electronic document certified by the EDS of the service provider's official.
When applying to a State Corporation, the result of the provision of a state service or a reasoned response to the refusal to provide a state service in the cases and on the grounds specified in Articles 165 and 166 of the Customs Code is issued on paper.
In the State Corporation issue of ready documents to the applicant are based on the receipt on reception of the relevant documents upon presentation of the identity (or his representative acting on the basis of a document issued in accordance with the civil legislation of the Republic of Kazakhstan, which specifies the relevant powers of the representative).
Condition of storage by the service provider, the State corporation of the documents unclaimed in time:
if the service recipient does not apply for the result of the state service within the specified period, the service provider ensures that they are stored at the place of reception until the service recipient receives them;
The state corporation ensures the storage of documents for 1 (one) month, after which it transfers them to the service provider for further storage.
If the service recipient applies after 1 (one) month, at the request of the State Corporation, the service provider within 1 (one) business day sends the completed documents to the State Corporation for delivery to the service recipient.
Chapter 3. Procedure for appealing decisions, actions (inaction) of service providers and (or) their officials, a State corporation and (or) its employees on the provision of public services
in the name of the head of service provider;
addressed to the head of the authorized body responsible for managing the provision of tax revenues and payments to the budget;
to the authorized body for the assessment and control of the quality of public services.
At the same time, a complaint about the actions (inaction) of employees of a State Corporation in the provision of services through a State Corporation is filed to the head of the State Corporation, or to the authorized body in the field of informatization.
The complaint of the service recipient received by the service provider, the State Corporation directly providing public services, is subject to consideration in accordance with paragraph 2 of Article 25 of the Law within 5 (five) working days from the date of its registration.
The complaint of the service recipient, received by the authorized body for the assessment and control of the quality of public services, is subject to consideration within 15 (fifteen) working days from the date of its registration.

1) service provider – Monday to Friday from 9.00 to 18.30 hours, with a lunch break from 13.00 to 14.30 hours, excluding weekends and holidays according to the Labor code of the Republic of Kazakhstan of November 23, 2015 (Labor code of RK). 2) State Corporation – from Monday to Saturday, with the exception of Sunday, public holidays in accordance with the Labor Code of the Republic of Kazakhstan in accordance with the established work schedule from 9.00 to 20.00 hours, without a lunch break. Reception is carried out in the order of the electronic queue, at the place of registration of the service recipient without accelerated service, it is possible to book an electronic queue through the portal; 3) the portal-around the clock, except for technical breaks in connection with the repair work (when the service recipient applies after the end of working hours, on weekends and holidays, according to the Labor Code of the Republic of Kazakhstan, the application is accepted and the result of the provision of public services is issued on the next working day). List of documents required for the provision of public services |
To a state corporation or to a portal: application in the form specified in Annex 3 to these Rules. Officer of the service provider carries out customs inspection of premises and territories of the applicant according to article 415 of the code of the Republic of Kazakhstan dated December 26, 2017 "About customs regulation in the Republic of Kazakhstan" (hereinafter – the Code) for compliance with the requirements defined by paragraph 3 of article 165 of the Code. During the inspection, the service recipient provides the official of the service provider with copies of documents confirming the fulfillment of the requirements specified in paragraph 3 of Article 165 of the Code. At the same time, copies of the submitted documents are attached to the act of customs inspection of the premises and territories, which remains with the service provider. |

Grounds for refusal to provide public services established by the laws of the Republic of Kazakhstan |
1) failure to submit the documents specified in paragraph 8 of this Annex 1 to the Rules. 2) non-compliance of the service recipient with the following conditions: being in the ownership, economic management, operational management or lease of premises and (or) in open areas, while the lease term must be at least six months from the date of submission of the application; the presence of certified weighing equipment that corresponds to the nature of the goods and vehicles being placed, and in the case of placing gas in special storage facilities – the presence of appropriate metering devices; the territory must be designated in accordance with Article 404 of the Code; availability of technically serviceable access roads, as well as places for inspection of goods that have a hard surface (concrete, asphalt, rubber or other hard surface), including covered areas equipped with electric lighting; the territory, including loading and unloading areas (one or more warehouses and platforms), must be located at the same postal address and have a continuous fence around the entire perimeter of the warehouse for storing its own goods. |

Other requirements, taking into account the specifics of the provision of public services, including through a state corporation
|
Customers with the prescribed Code of the Republic of Kazakhstan dated 18 September 2009 "On people's health and healthcare system" a complete or partial loss of the ability or capacity to exercise self, to move independently, to focus, documents acceptance for rendering the state service is performed by an employee of the State Corporation with departure at the place of residence by applying through a Single contact center 1414, 8 800 080 777 (when providing services through a state corporation). The service recipient has the opportunity to receive the state service in electronic form through the portal, provided that the EDS is available. The service recipient has the opportunity to receive information about the status of the provision of public services in the remote access mode through a Single contact Center. |
