WHAT YOU NEED TO KNOW ABOUT MOBILE TRANSFERS IN 2024

1. WHY DO I NEED TO CHECK MOBILE TRANSFERS?
Verification of mobile transfers is aimed at bringing illegal business activities out of the shadows.
Some entrepreneurs receive payment for goods or services sold through mobile transfers. However, these transfers are made without the use of cash registers, POS terminals and QR codes. Accordingly, checks are not issued and consumer rights are infringed.
It should be emphasized that the state will not check all mobile transfers.
Only persons who have received mobile transfers from 100 or more different persons monthly for three consecutive months will fall under the verification criteria. That is, if there are signs of entrepreneurial activity.
2. IS IT POSSIBLE TO TRANSFER MONEY TO FAMILY AND FRIENDS?
Individuals, as before, can make and accept mobile transfers for their personal purposes: to relatives, friends, parents and children and for other life situations. There are no restrictions in this regard.
3. SOME ENTREPRENEURS REFUSE TO ACCEPT CASHLESS PAYMENTS AND HAVE STARTED DEMANDING PAYMENT ONLY IN CASH. IS IT LEGAL?
According to the norms of the Law of the Republic of Kazakhstan "On Payments and Payment Systems", various payment methods are provided – by bank card, QR payment or cash (Article 25).
Refusal to accept non-cash payments is unlawful and violates the rights of consumers.
For the refusal of entrepreneurs to accept payments using payment cards, administrative liability is provided for the first time a warning, in case of repeated violation – a fine of 147,680 tenge (40 MCI) (Article 194 of the Administrative Code).
4. WHERE TO CONTACT IF the ENTREPRENEUR REFUSES TO ACCEPT CASHLESS PAYMENT?
It is necessary to contact the state revenue authorities at the place of residence about all the facts of refusal to accept non-cash payments.
5. WHAT SHOULD TAXI DRIVERS DO, FOR EXAMPLE? THEY CAN'T CARRY CASH REGISTERS WITH THEM.
Private cab drivers need to register as an individual entrepreneur. This can be done through the mobile applications of "e-Salyq Business", "Egov Mobile" and some second-tier banks ("Halyq bank", "Kaspi bank", "BankCenterCredit").
At the same time, to accept non-cash payments, you can open an entrepreneurial bank account online, where payment for services rendered will be received. All you need is a smartphone. There is no need to carry cash registers and POS terminals with you.
6. WILL THIS INITIATIVE LEAD TO AN OUTFLOW OF ENTREPRENEURS INTO THE "SHADOW"?
It is now much more profitable to fulfill tax obligations in good faith.
Favorable conditions have been created for the conduct and development of business. The procedures of tax regimes have been simplified – tax rates range from only 1% to 4%, depending on the type of activity.
If, under such conditions, an entrepreneur accepts mobile transfers, then he is already in the shadows and falls under tax control.
At the same time, the verification of mobile transfers does not affect bona fide taxpayers.
Thus, the principles of fairness and mandatory taxation are implemented, where all taxpayers are on equal terms and pay taxes on their income.
