Electronic customs escort in Kazakhstan

From January 16 of this year Amendments to the customs legislation come into force, allowing the state revenue authorities to determine in real time the exact location along the route of a freight vehicle. On January 5, 2021, the Law of the Republic of Kazakhstan No. 407-VI "On Amendments and Additions to Certain Legislative Acts of the Republic of Kazakhstan on Customs Regulation and Business Activities" was adopted. One of the novelties of the adopted amendments is the introduction of the possibility of using electronic customs escort of a vehicle through the use of satellite navigation, which allows in real time to determine the exact location along the route of the vehicle. Within the framework of these additions, it is also provided for the customs authority to inform the declarant and the carrier in the event that the customs authority makes a decision to use electronic customs escort. Direct electronic customs escort is carried out by the national operator of the international road transport tracking information system. Such an operator has already been identified in the Republic of Kazakhstan. It should be noted that earlier amendments were made to the Law of the Republic of Kazakhstan "On Road Transport", which provides for the concept of "national operator of the international road transport tracking information system", as well as the competence of the Government of the Republic of Kazakhstan to determine the national operator of the international road transport tracking system. At the same time, within the framework of these amendments, the specified operator provides services for renting navigation seals that are hung on vehicles and with the use of which the movement of the vehicle is tracked. Currently, a draft Procedure for the implementation of electronic customs escort of vehicles has been developed, which defines the interaction of the customs authority, the declarant, the carrier and the national operator of the information system for tracking international road transport.
