Who was exempted from participation in the general declaration in Kazakhstan?
In Kazakhstan, non-residents of the country were exempted from participation in the general declaration. Additionally, the founders of non-profit organizations (NPOs) and shareholders are not required to submit declarations at the third stage.
In 2024, the third stage of the general declaration began in Kazakhstan. Individual entrepreneurs, founders and heads of legal entities, as well as their spouses, are participating for the first time. Previously, Kazakhstan considered the possibility of exempting certain categories of the population from the universal declaration system.
Now, changes to the Tax Code of the Republic of Kazakhstan have been signed, clarifying who exactly may not submit "input" declarations on the assets and liabilities of an individual in form 250. Thus, non-residents no longer need to participate in the general declaration. The Law of the Republic of Kazakhstan "On introducing amendments and additions to the Code of the Republic of Kazakhstan 'On taxes and other obligatory payments to the budget'" and the Law of the Republic of Kazakhstan "On the entry into force of the Code of the Republic of Kazakhstan 'On taxes and other obligatory payments to the budget'" dated July 1, 2024, No. 105-VIII ZRK, introduced amendments and additions to Article 45-1, excluding, from January 1, 2024, non-resident individuals from the circle of declarants obligated to submit declarations on assets and liabilities.
At the same time, at the third stage of the general declaration, the founders of non-profit organizations (NPOs) and all shareholders, whether majority, minority, foreign or Kazakh joint-stock companies (JSC), are exempt from the obligation to submit declarations. Their participation is postponed to 2025. Let us recall that at the fourth stage of the universal declaration, starting from January 1, 2025, it is planned to cover the remaining categories of citizens, including employees of private structures, housewives, pensioners, students, and others.
