On the basis of Article 413 of the Code of the Republic of Kazakhstan "On Customs Regulation in the Republic of Kazakhstan" (hereinafter referred to as the Code), a form of customs control is applied – customs inspection, in compliance with the provisions of the Rules of Customs Inspection and Inspection (hereinafter referred to as the Rules), approved by Order No. 188 of the Minister of Finance of the Republic of Kazakhstan dated February 14, 2018.
At the same time, Chapter 48 of the specified Code regulates:
Article 428. Use of technical means of customs control, other technical means, water and aircraft of customs authorities
When conducting customs control, customs authorities may use technical means of customs control (equipment, instruments, measuring instruments, devices and instruments) and other technical means.
The list and procedure for the use of technical means of customs control are approved by the authorized body.
Technical means of customs control must be safe for the life and health of humans, animals and plants and must not cause harm to persons, goods and vehicles.
The Commission has the right to adopt recommendations on standard technical requirements for individual technical means of customs control used by customs authorities.
Technical means of customs control may be used by customs authorities when conducting other types of state control (supervision) carried out by customs authorities, in accordance with the legislation of the Republic of Kazakhstan.
Customs control in respect of goods transported across the customs border of the Eurasian Economic Union may be carried out using water and aircraft of customs authorities.
The procedure for the use of water and aircraft of the customs authorities for the purpose of customs control is determined by the authorized body.
