In accordance with the Law of the Republic of Kazakhstan "On Social Protection of persons with disabilities in the Republic of Kazakhstan", local executive bodies of the region, the city of republican significance and the capital provide sanatorium-resort treatment of persons with disabilities and children with disabilities in accordance with the individual program of habilitation and rehabilitation of persons with disabilities (IPAR), stay in a sanatorium-resort organization a legal representative accompanying a child with a disability to sanatorium treatment (paragraph 2 of article 10).
One of the legal representatives accompanying a child with a disability to sanatorium treatment has the right to reimbursement by local executive bodies of the cost of staying in a sanatorium organization in the amount of seventy percent of the guaranteed amount provided as compensation for the cost of sanatorium treatment determined by the authorized body in the field of social protection of the population (paragraph 3 of Article 20 Of the Law).
Regarding the application for the provision of services when accompanying a child with a disability
The "Application for the provision of sanatorium treatment" - Appendix 2 to the Rules for the provision of sanatorium treatment to persons with disabilities and children with disabilities in accordance with the individual program of habilitation and rehabilitation of persons with disabilities (Order No. 26) has been supplemented:
"I ask you to accept the documents for the provision of sanatorium treatment:
a person with a disability;
a child with a disability;
accompanying a child with a disability in accordance with paragraph 3 of Article 20 of the Law of the Republic of Kazakhstan "On Social protection of persons with disabilities in the Republic of Kazakhstan". (please note)
The legal representative of a child with a disability who needs to be accompanied to a sanatorium treatment makes an appropriate note when submitting an application.
Note: the application for the provision of spa treatment is submitted alone, without specifying the data of the accompanying person.
Regarding the legal representative accompanying a child with a disability for sanatorium treatment
In accordance with the Code of the Republic of Kazakhstan "On Marriage (Matrimony) and Family", the legal representatives of the child are parents (parent), adoptive parents (adoptive parents), guardian or trustee, foster parent (foster parents), foster carer and other persons replacing them who, in accordance with the legislation of the Republic of Kazakhstan, provide care, education, upbringing, protection of the rights and interests of the child.
The presence of an accompanying child with a disability in a sanatorium-resort organization is allowed if there is a document confirming the status of a legal representative.
Choosing a provider on the Social services portal
When choosing a provider on the social services portal, a parent (guardian, trustee) may refuse to accompany a child with a disability to sanatorium treatment, if there is a mark in the Application for the provision of sanatorium treatment.
Accommodation of a child with a disability and an accompanying person in a sanatorium-resort organization in only one room.
Attention! Attention! When accompanied by a child over the age of 7, when choosing a sanatorium-resort organization, it is necessary to answer the question "About the coincidence of the gender of the accompanying person and a child with a disability".
In the following cases:
- mismatch of the sex of the child and the accompanying person, only sanatorium-resort organizations where there are available double rooms will be displayed;
- matching the sex of the child and the accompanying person, all sanatorium-resort organizations where there are available double, triple, quadruple, etc. rooms will be displayed.
At the same time, the cost of double rooms may be higher than the approved guaranteed amount for spa treatment.
Suppliers, if it is impossible to accept children with an accompanying person for sanatorium treatment (for example, children's sanatoriums), reject the application with justification (in the "other" field, the justification for refusal is entered).
In the Application for reimbursement to the supplier of the guaranteed amount, when accompanied by a child with a disability for sanatorium treatment by one of the legal representatives, two guaranteed amounts are indicated:

For reference: 100% GP for the sanatorium treatment of a child with a disability.
______________ tenge (amount) in accordance with paragraph 3 of Article 20 of the Law of the Republic of Kazakhstan "On Social Protection of persons with disabilities in the Republic of Kazakhstan".
For reference: 70% of the GP for a stay in a sanatorium-resort organization.
Arrival at the sanatorium and resort organization and departure
Upon arrival at the sanatorium-resort organization, the accompanying person provides:
- identity document;
- a document confirming the status of a legal representative;
- a sanatorium-resort card in cases where he plans to undergo sanatorium-resort treatment at his own expense or an epidemiologist's certificate on the absence of contact with infectious patients at the place of residence, if he does not plan to undergo sanatorium-resort treatment.
If there is an accompanying person, the arrival and departure to the sanatorium-resort organization of a child with a disability is accompanied only.
Note: The accompanying person cannot leave, leaving the child or stay, sending the child.
Regarding the payment for the services of sanatorium-resort treatment of an accompanying child with a disability
According to the Rules for reimbursement of the cost of goods and services from the state budget when selling them to persons with disabilities through the social services portal (Order No. 14), the provider of sanatorium treatment provides to the authorized body:
1) an act of work performed (services rendered) in the form approved by Order No. 562;
2) an invoice, as well as a receipt, in cases of payment of the difference between the guaranteed amount and the actual cost of sanatorium treatment by the recipient independently at their own expense.
Taking into account a single Application for compensation to the supplier of the guaranteed amount, compensation for the stay of a legal representative accompanying a child with a disability, local executive bodies are reimbursed according to a single act of work performed (services rendered), indicating in separate lines the amount of compensation for sanatorium treatment of a child with a disability and the amount of compensation to the accompanying person.
