on the results of internal analysis of corruption risks in work

INTRODUCTORY PART
Based on the order of the akim of the State Institution “Apparatus of the Akim of the Zhalanash Rural District of the Kegen District” of the Almaty Region (hereinafter referred to as the apparatus) dated September 20, 2023 No. 33-ө-n/k “On conducting an internal analysis of corruption risks in the activities of the apparatus”, in the period from 01 January to 30
September 2023, an internal analysis of corruption risks was carried out. The general period for conducting an internal analysis of corruption risks is 9 months of 2023.
In accordance with the Rules for Internal Analysis of Corruption Risks, approved by Presidential Decree No. 12 of October 19, 2016, an internal analysis was carried out in the following areas:
IDENTIFYING CORRUPTION RISKS IN REGULATIVE LEGAL ACTS AFFECTING THE ACTIVITIES OF THE STAFF
The office of the akim of the Zhalanash rural district in its activities is guided by:
-Law of the Republic of Kazakhstan “On local government and
self-government in the Republic of Kazakhstan"
- Law of the Republic of Kazakhstan “On Civil Service of the Republic of Kazakhstan”
-Code of Ethics for Civil Servants of the Republic of Kazakhstan
(Rules of official ethics of civil servants)
- Law of the Republic of Kazakhstan “On Public Procurement”;
-Law of the Republic of Kazakhstan “On architectural, urban planning and construction activities in the Republic of Kazakhstan”;
- Law of the Republic of Kazakhstan “On the procedure for considering appeals from individuals and legal entities”
- Civil Code of the Republic of Kazakhstan
- Land Code of the Republic of Kazakhstan
- Labor Code of the Republic of Kazakhstan
- Regulations “On the state institution “Apparatakim of the Zhalanash rural district of the Kegen region”
According to regulatory legal acts.
For 9 months of 2023, the district akim issued 11 decisions, 34 orders on core activities and 31 orders on personnel. A report on orders for core activities is submitted quarterly for analysis to the Department of Justice of the Panfilov District. Based on the results of 3 quarters, there were no comments from the specialists of the University of Justice of the Kegen region. Orders for personnel and orders for core activities are entered into the E-Kyzmet database. There were no protests from the Kegen district prosecutor regarding the cancellation of decisions and orders during the reporting period.
2. To consider applications from individuals and legal entities.
According to the functional responsibilities, the chief specialist is responsible for the registration, timely and high-quality execution of received requests from individuals and legal entities. Indira Masetbaevna Kurmanbekova.
For 9 months of 2023, the office of the akim of the Zhalanash rural district received 44 requests from individuals, of which under the “Auyl Amanaty” program - 22, Employment - 6, heating - 3, documentation - 12, road issues - 1. During this period, no requests were received from legal entities.
No appeals or complaints were received from residents on the district akim’s website.
Recommendation: Strictly comply with the requirements of the Law of the Republic of Kazakhstan “On the procedure for considering appeals from individuals and legal entities,” and also conduct a seminar among employees of the akim’s office on the consideration of appeals.
For the provision of public services.
According to the register of public services, the akim’s office provides the following public services:
The office of the akim of the Zhalanash rural district for 9 months of 2023, according to the register of public services, provided 5 types of public services:
1) Providing free transportation to educational institutions and back home for children living in remote rural areas – 0;
2) Putting preschool children (up to 7 years) on the waiting list for referral to preschool organizations – 0;
3) Issuance of a certificate confirming that the applicant (family) is a recipient of targeted social assistance – 0;
4) Issuance of a decision on changes in purpose – 0;
5) Provision of a land plot for the construction of an object within the boundaries of a populated area – 0;
6) Acquisition of rights to land plots that are state-owned, not requiring bidding (competitions, auctions) – 1;
7) Sale into private ownership of a land plot previously allocated for land use – 0;
8) Queue to receive a land plot – 0;
Total number of services provided –0;
The number of government services provided in paper form is 0.
Control over the quality of public services
In the building of the akim's office of the rural district, stands with information about the procedure for providing public services are posted. To ensure transparency in the process of providing public services in the rural district, explanatory work is being carried out among the population.
In the provision of public services, specialists from the district akim’s office were not subject to disciplinary action.
According to paragraph 1 of clause 1 of Article 23 of the Law of the Republic of Kazakhstan “On Public Services”, information on the procedure for the provision of public services is provided by posting public service standards at the locations of service providers and the State Corporation.
During the analysis, it was established that there is an information board in the building of the Akim’s office.
For violation of the Code of Ethics for Civil Servants of the Republic of Kazakhstan (Rules of Official Ethics for Civil Servants).
During the reporting period, specialists from the district akim’s office were not subject to disciplinary action for violating the Code of Ethics.
Recommendation: In order to monitor compliance with professional ethics standards, as well as the state of the moral and psychological climate in the team, at least once every six months, the ethics officer conducts an anonymous survey using a form approved by the authorized body.
Personnel management, including staff turnover
According to the staffing table for 2023, the staffing level of the State Institution “Apparatus of the Akim of the Zhalanash Rural District” is 7 people.
The staffing level of the district akim's apparatus is 7 units, including: akim of the Zhalanash rural district - 1 unit, deputy akim - 1 unit, head of a structural unit - 1 unit, chief specialists - 4.
During the analyzed period, there were no facts of bringing employees of the district akim’s office to justice for committing corruption offenses, as well as offenses discrediting the public service.
The job descriptions of civil servants of the akim's apparatus fully reflect their official rights and responsibilities; there are no facts of duplication of duties of employees.
There were no facts of demotion from among the employees of the okrug akim's apparatus.
