Paragraph 3. Procedure for approving a construction Sketch (Sketch project) and providing public services "approving a Sketch (Sketch project)"
47.the State Service" approval of the Sketch (Sketch project) " (hereinafter referred to as the 2nd public service) is carried out by local executive bodies of the cities of Nur – Sultan, Almaty and Shymkent, districts and cities of regional significance.
48.after receiving the source materials and developing a Sketch (Sketch project), the applicant coordinates with the service provider.
The composition and content of the Sketch (Sketch project) should correspond to the purpose, main parameters, deviations from the set of requirements for the decision regarding the location of the object on a specific land plot and the color in accordance with the architectural and artistic coloristics of the construction of streets, blocks and residential areas, set out in Annex 3 to these rules.
49.to obtain the 2nd public service, the applicant sends an application through the portal to the service provider in accordance with annex 6 to these rules with the attachment of an electronic copy of the Sketch (Sketch project).
It is not allowed to request documents not provided for in this paragraph.
The service provider receives information about the identity document, about the state registration (re-registration) of a legal entity, about registration as an individual entrepreneur from the relevant State Information Systems through the e-Government Gateway.
The list of basic requirements for the 2nd public service, including the nature of the process, the form, content and result of the provision of services, as well as other information, taking into account the specifics of the 2nd public service, is recorded in the form of the standard of public service in accordance with annex 7 to these rules.
50.when the applicant submits all the necessary documents through the portal – in the "personal account" of the applicant, the status of acceptance of the request for the provision of the 2nd public service is indicated, indicating the date of receipt of the result of the 2nd public service.
51.the service provider registers documents and information on the day of receipt.
If the applicant applies after the end of working hours, on weekends and holidays in accordance with the labor legislation of the Republic of Kazakhstan, acceptance of the application and issuance of the result of rendering the 2nd public service is carried out on the next working day.
52.after registration of the application and the attached Sketch (Sketch project), the service provider checks the completeness of the submitted documents within 2 (two) business days from the date of receipt of the documents.
If the applicant submits an incomplete set of documents, the service provider prepares a reasoned refusal to further consider the application within the specified time frame and sends it to the applicant's "personal account" in the form of an electronic document signed with the EDS of the service provider.
If the submitted documents are complete, the service provider reviews the attached documents and considers the applicant and (or) the submitted materials, objects, data and information necessary for the provision of the 2nd public service for compliance with the requirements established by these rules.
53.based on the results of consideration of documents for the provision of Public Services 2, within the time limits specified in these rules, the service provider prepares a letter of agreement or a reasoned refusal.
The result of the 2nd public service is sent by the service provider to the applicant's "personal account" in the form of an electronic document signed with an EDS.
54. the service provider refuses to provide the 2nd public service on the following grounds:
1) determination of the inaccuracy of documents submitted by the applicant for obtaining the 2nd Public Service and (or) the data (information) contained in them;
2) non-compliance of the applicant and (or) the submitted materials, objects, data and information necessary for the provision of the 2nd public service with the requirements established by these rules;
3) non-compliance of the Sketch (Sketch project) with the composition and content set out in Annex 3 to these rules;
4) non-compliance of the Sketch (Sketch project) with the set of requirements for its assignment;
5) inconsistency of the Sketch (Sketch project) with the main parameters;
6) inconsistency of the Sketch (Sketch project) with the location of the object on a specific land plot;
7) inconsistency of the Sketch (Sketch project) with the color decision in accordance with the architectural and artistic coloristics of the construction of streets, blocks and residential areas;
8) non-compliance of the Sketch (Sketch project) with state standards in the field of Architecture, Urban Planning and construction.
The applicant is issued a reasoned refusal, indicating the reasons and specific comments for elimination.
In case of elimination of the reasons for refusal to provide the 2nd public service, the applicant applies again to obtain the 2nd public service in accordance with the procedure established by the legislation of the Republic of Kazakhstan.
It is impossible to have a subsequent refusal on the grounds that existed before, but were not specified.
54-1.in the presence of grounds provided for in paragraph 54 of these rules and paragraph 9 of the 2nd standard of Public Service, the service provider sends the applicant a notification on the preliminary decision to refuse to provide a public service, as well as on the time and place of the hearing to allow the applicant to take a position on the preliminary decision.
Notification of the hearing is sent at least 3 (three) business days before the end of the term of rendering a public service. The hearing is held no later than 2 (two) business days from the date of notification.
Based on the results of the hearing, the applicant is sent a positive result or a reasoned refusal to provide a public service in the form of an electronic document signed by the EDS of the Authorized Person of the service provider.
55.after approval of the Sketch (Sketch project), the service provider takes it into account.
56.the term for rendering the 2nd public service or submitting a reasoned refusal is 10 (ten) business days.
57.the service provider ensures that data on the 2nd stage of rendering public services are entered into the information system for monitoring the provision of public services in accordance with the procedure established by the authorized body in the field of informatization.
When rendering public services 2 through the State Information System of permits and notifications, data on the stage of rendering public services are automatically entered into the information system for monitoring the provision of public services.
58.consideration of a complaint on the provision of Public Services is carried out by a higher administrative body, an official, an authorized body for assessing and monitoring the quality of public services rendered (hereinafter referred to as the body considering the complaint).
The complaint is submitted to the service provider and (or) the official whose decision, action (omission) is being appealed.
The service provider, the official whose decision, action (omission) is being appealed, sends it and the administrative case to the body considering the complaint no later than 3 (three) business days from the date of receipt of the complaint.
At the same time, the service provider, official, whose decision, action (omission) is being appealed, does not send a complaint to the body considering the complaint, if within 3 (three) working days it makes a decision or other administrative action that fully satisfies the requirements specified in the complaint.
The applicant's complaint received by the service provider is subject to consideration within 5 (five) business days from the date of registration in accordance with paragraph 2 of Article 25 of the law of the Republic of Kazakhstan "on public services".
The applicant's complaint received by the authorized body for assessing and monitoring the quality of public services is subject to consideration within 15 (fifteen) business days from the date of its registration.
59.appeal to the court is allowed after appeal in a pre-trial manner in accordance with paragraph 5 of Article 91 of the administrative procedural code of the Republic of Kazakhstan, unless otherwise provided by the laws of the Republic of Kazakhstan.
