Abstract

Environmental impact assessment for the Working Project "coastal improvement of the City Beach zone" of the 1st, 2nd stage was carried out on the basis of contracts No. 161 dated 26.06.2020, No. 153 dated 26.06.2020 and in full compliance with the legal and regulatory acts on Environmental Protection in force in the Republic of Kazakhstan.

The need for the development of EIA is defined in Article 36 of the Environmental Code of the Republic of Kazakhstan: "environmental impact assessment is mandatory for any type of economic and other activities that may directly or indirectly affect the environment and public health."

In accordance with the sanitary rules "sanitary and epidemiological requirements for the establishment of sanitary protection zones of production facilities" approved by the order of the Minister of national economy of the Republic of Kazakhstan dated 20.03.2015 No. 237, recreation areas are not included in the list of sanitary classification objects.

In accordance with the specified sanitary rules, placement works are not subject to sanitary classification.

The nearest residential building is located at a distance of 2400 m from the residential area.

The main purpose of the OS impact assessment is to identify the environmental and social impact of activities; develop proposals to prevent environmental degradation or minimize negative impacts on it. The Department of Environmental Protection is the third stage of Environmental Impact Assessment (EIA), in which the characteristics and parameters of Environmental Impact are determined in accordance with the specific technical decisions considered in the project documentation, briefly but in sufficient volume to analyze the decisions taken and ensure environmental protection from the negative impact of the object under consideration.

The following materials are presented in this project:

overview of the current state of the environment of the enterprise area;
General Data (type of activity, number of industrial sites, main indicators of improvement);
assessment of the impact of the enterprise on atmospheric air (calculation of emissions of pollutants, provision of standards for maximum permissible emissions, justification of the rates of the sanitary protection zone));
assessment of the impact of the Enterprise On Water Resources and soil (calculation of water consumption and disposal, waste generation volumes);
assessment of the impact of activities on the socio-economic environment, plant and animal world of the region;
environmental impact statement.

The main directive and regulatory documents, instructions and methodological recommendations listed in the list of references used in the development of the project were used.

Calculations of atmospheric air pollution were carried out in the software complex "era", LLC NP "logos-plus" (Novosibirsk), certificate of conformity No. POCC Ru.SP09. N00010 Gosstandart of Russia, soglasova LLP "Republican scientific and research center of atmospheric air" No. 38 from 18.04.2005

In accordance with paragraph 3 of Article 57 of the Environmental Code of the Republic of Kazakhstan, paragraph 8 of the instructions for assessing the impact of economic activities on the environment provided for in the development of pre-planning, pre-design and project documentation, approved by the order of the minister of Environmental Protection of the Republic of Kazakhstan dated 28.06.2007, paragraph 54. No. 204-P (with changes and additions as of 19.03.2012) the results of the EIA of pre-design and design materials of the planned economic activity, which can have a significant impact on the environment and human health, taking into account one of three parameters, namely: the size, period and intensity of impact.

In this project, a comprehensive environmental impact assessment was carried out. The analysis of the impact on atmospheric air, underground and surface water, soil cover and subsoil, vegetation and wildlife, human health allows us to conclude that the activities provided for in the normal mode do not have a negative impact on the natural environment with high importance and are therefore allowed in terms of environmental risks.

All possible negative effects are characterized as low and medium.

In 2000, the Republic of Kazakhstan ratified the Aarhus Convention, the law of the Republic of Kazakhstan dated 23.10.2000 No. 92-II of the Republic of Kazakhstan "on ratification of the convention on public participation in the decision-making process on access to information, access to judicial justice on environmental issues". Annex 1 to Article 6 of the convention sets out specific types of activities that require public participation in making any decisions.

These design decisions consider the work on the placement of a recreation area. This service is not included in the list of activities that require public hearings (Article 6 of Annex 1 to the Aarhus Convention).

In accordance with paragraph 2 of Article 2 of the Environmental Code, "if an international treaty ratified by the Republic of Kazakhstan establishes rules other than those contained in this code, the provisions of the international treaty shall apply»

In connection with the above, public hearings on these project decisions are not held.

According to Paragraph 1 of Article 57 of the Environmental Code of the Republic of Kazakhstan, an application for state environmental expertise of the project has been published in the mass media.

"In accordance with article 21-1 of the Code of the Republic of Kazakhstan ""on public health and the healthcare system"", sanitary and epidemiological conclusions are submitted to projects for the construction, reconstruction and expansion of objects of high epidemic significance, subject to state sanitary and epidemiological control and supervision, projects of master plans for the construction of urban and rural settlements, resort areas and detailed planning plans."

In this regard, it is not necessary to conduct a sanitary and epidemiological examination of the project of work on the placement of Recreation Area facilities and issue a sanitary and epidemiological conclusion and assess the impact on the environment on them.

Improvement of the City Beach Coastal Zone of the 1st, 2nd stage is located on the shore of the lake. Balkhash and water fall into the protection belt.

Compliance with a special regime on the territory of water protection zones is an integral part of the complex of environmental measures to improve the hydrological, hydrochemical, hydrobiological, sanitary and ecological state of water bodies and improve their coastal territories. A special mode of economic activity is regulated by the following legal documents::

Based on the requirements of Paragraph 2 of Paragraph 1 of Article 125 of the KH of the Republic of Kazakhstan, it is prohibited to build and operate buildings and structures within water protection zones, except for water management and sanitation facilities and their communications, bridges, bridge structures, berths, ports, piers and other transport infrastructure facilities related to water transport activities, as well as recreational areas on the water body.

According to Paragraph 1 of Article 51 of the law on architecture "recreational zones in localities are intended for the organization and arrangement of recreation areas for the population and include Gardens, Forest Parks, Parks and squares, zoos, reservoirs, beaches, water parks, landscape architecture objects, other places of recreation and tourism, as well as buildings and structures for recreation and (or) recreation purposes in accordance with this paragraph. Paragraph 3 of this article states that "on the territory of the recreational zone, it is not allowed to place (build) new industrial, municipal and warehouse facilities, buildings and structures for residential and civil purposes and expand existing ones that are not directly related to the functioning of the recreational zone.

The main type of landscaping activity is the organization of cultural and sports recreation of residents and tourists on the shores of Lake Balkhash in the summer period. The buildings and buildings are designed for the functioning of the beach area and the service of vacationers.

Thus, a beach recreation area located on the territory and having all the buildings and structures described in the design materials meets the requirements of the regulatory legal documentation of the Republic of Kazakhstan.
