The state institution "Balkhash city construction Department" is a state body of the Republic of Kazakhstan that provides management in the field of construction in the territory of the city of Balkhash.
The state institution "Balkhash city construction Department" carries out its activities in accordance with the Constitution and laws of the Republic of Kazakhstan, acts of the President and Government of the Republic of Kazakhstan, other regulatory legal acts, as well as this Regulation.
The state institution "Balkhash city construction Department" is a legal entity in the organizational and legal form of a state institution, has seals and stamps with its name in the state language, forms of the established sample, in accordance with the legislation of the Republic of Kazakhstan accounts in the Treasury bodies.
State institution "Department of construction of Balkhash town" enters in civil-legal relations from own name.
The state institution "Balkhash city construction Department" has the right to act as a party to civil law relations on behalf of the state, if it is authorized to do so in accordance with the legislation.
State institution "Department of construction of Balkhash town" on questions of its competence in accordance with legislation makes decisions orders of the head of the state institution "Department of construction of Balkhash town" and other acts, stipulated by the legislation of the Republic of Kazakhstan.

The present Regulation is the constituent document of the state institution "Department of construction of Balkhash town".
The activities of the state institution "Balkhash city construction Department" are financed from the local budget.
The state institution "Department of construction of the city of Balkhash" is prohibited from entering into contractual relations with business entities in order to perform the duties that are the functions of the state institution "Department of construction of the city of Balkhash".
If the state institution "Department of construction of the city of Balkhash" is granted the right to carry out income-generating activities by legislative acts, the income received from such activities is directed to the state budget revenue.
Mission, main tasks, functions, rights and duties of the state body
Mission: implementation of the state policy in the field of budget construction.
Tasks:
implementation of state policy in the field of construction activities in the relevant territory;
improving the quality of work related to the construction policy, organization of rational development and effective implementation of construction solutions for the territorial development of urban settlements;
promotion of infrastructure and construction development based on the transformation of the resource and technological base;
organization of construction of social, engineering and transport infrastructure on the territory of individual residential development;
development of the base of normative and technical documentation for the design of objects;
organization of works and implementation of construction programs aimed at solving current and future problems of integrated socio-economic development of the city's settlements;
organization of a construction project;
coordination of all related sections of construction documentation;
other tasks stipulated by the legislation of the Republic of Belarus
Kazakhstan.
Functions:
Informing the city's population about the planned development or other urban planning changes;
Approval and implementation of urban development projects, projects of detailed planning and development of the city and suburban area;
Decision-making on construction (expansion, modernization, upgrading, reconstruction, restoration, capital repair) of buildings, buildings, constructions, engineering and transport communications, as well as engineering preparation of the territory accomplishment and landscaping, conservation of buildings (objects), the execution of works on postoptimization objects of local significance;
Determination of the composition and appointment of the Commission for the acceptance of objects (complexes) into operation in accordance with the legislation of the Republic of Kazakhstan, as well as registration and accounting of objects (complexes) put into operation;
Monitoring of facilities and complexes under construction (planned for construction) in accordance with the procedure established by the Government of the Republic of Kazakhstan;
Development and approval of an annual public procurement plan based on the relevant budget (development plan) or individual financing plan related to the purchase of goods, works, and services necessary to ensure the functioning and performance of public functions.

the involvement of engineering services;
providing the facility with all necessary permits provided by the legislation of the Republic of Kazakhstan;

Implementation of other functions within its competence in accordance with the legislation of the Republic of Kazakhstan.
Rights and responsibilities:
request and receive in accordance with the established procedure from state bodies, organizations, officials, regardless of ownership, information necessary to perform the tasks assigned to the state institution "Balkhash city construction Department" ;
instruct local Executive bodies, enterprises and organizations of all forms of ownership to prepare materials for solving certain issues within the competence of the state institution "Balkhash city construction Department", to enter with proposals for involving employees of other departments and organizations with the consent of their heads in the implementation of activities carried out by the state institution "Balkhash city construction Department" in accordance with its functions;
create expert groups of specialists at the state institution "Balkhash city construction Department" in accordance with the established procedure;
submit proposals for the consideration of the mayor of the city and the city maslikhat on issues related to their competence;
suspend the production of works performed with a deviation from the project, in violation of building codes and technical conditions, and demand the elimination of violations;
exercise other rights and obligations in accordance with the legislation of the Republic of Kazakhstan.
Organization of the state body's activities
The management of the state institution "Balkhash city construction Department "is carried out by the first head, who is personally responsible for performing the tasks assigned to the state institution" Balkhash city construction Department " and performing its functions.
The first head of the state institution "Balkhash city construction Department" is appointed and dismissed by the mayor of Balkhash.
Powers of the first head of the state institution " Balkhash city construction Department»:

2) manages the work of the state institution "Balkhash city construction Department" and is personally responsible for performing the functions and tasks assigned to it;
3) conducts a personal reception of citizens in accordance with the reception schedule, considers the requests of individuals and legal entities within the terms established by law, and takes the necessary measures for them;
4) in accordance with the procedure established by law, resolve issues of acceptance and dismissal, bringing to disciplinary responsibility, and encouraging employees;
5) gives instructions that are mandatory for employees of the Department, signs official documentation;
6) monitors the targeted use of budget funds;
7) organizes anti-corruption activities and compliance with anti-corruption legislation;
8) exercise other powers in accordance with the legislation of the Republic of Kazakhstan on issues related to its competence.
Execution of the powers of the first head of the state institution "Balkhash city construction Department" during his absence is carried out by a person who replaces him in accordance with the current legislation.
