    The state institution "Department of culture and language development of the city of Balkhash" is a state body of the Republic of Kazakhstan that provides guidance in the field of culture and language development.
    2. the State institution "Department of culture and language development of the city of Balkhash" has departments:

    2) Municipal state-owned enterprise " Balkhash club of the deaf»;
    3) Municipal state-owned enterprise " Historical and local history Museum of the city of Balkhash»;
    4) Municipal state institution " Tilder ortalygy»;
    5) Municipal state-owned enterprise "Cultural and leisure center of the city of Balkhash".
    3. State institution "Department of culture and languages development of Balkhash town" realizes its activity in accordance with the Constitution and laws of the Republic of Kazakhstan, acts of President and Government of the Republic of Kazakhstan, other regulatory legal acts and these regulations.
    4. State institution "Department of culture and languages development of Balkhash town" is a legal entity in organizational-legal form of state establishment, has seals and stamps with its name in state language, forms of the established sample in accordance with the legislation of the Republic of Kazakhstan accounts in the Treasury bodies.
    5. the State institution "Department of culture and language development of the city of Balkhash" enters into civil relations on its own behalf.
    6. the State institution "Department of culture and language development of the city of Balkhash" has the right to act as a party to civil law relations on behalf of the state, if it is authorized to do so in accordance with the legislation.

State institution "Department of culture and languages development of Balkhash town" is forbidden to enter contractual relations with entrepreneurial entities for the matter of performing of the duties which are functions of state institution "Department of culture and languages development of Balkhash town".
    If the state institution "Department of culture and language development of the city of Balkhash" is granted the right to carry out income-generating activities by legislative acts, then the income received from such activities is sent to the state budget.
    Mission, main tasks, functions, rights and duties of the state body
    The mission of the state institution "Department of culture and language development of the city of Balkhash" is to provide high-quality and affordable services in the field of culture and language policy that contribute to the formation of a modern cultural and tolerant language environment, as well as social optimism of citizens living in the city.
    15. Tasks:
    1) creation, preservation and further development of a network of organizations, institutions, enterprises of the city's culture and language policy (paragraph 2, article 4 of the Law of the Republic of Kazakhstan "on culture" and paragraph 3, article 25 of the Law of the Republic of Kazakhstan " on languages in the Republic of Kazakhstan»);
    2) management of the activities of institutions, enterprises, cultural organizations, providing methodological and practical assistance, regulating their work (paragraph 6, article 4 of the Law of the Republic of Kazakhstan " on culture»);
    3) assistance in participating and achieving high results in city and regional competitions, festivals, in identifying and supporting young talents paragraph 3, article 25 of the Law of the Republic of Kazakhstan " on languages in the Republic of Kazakhstan»;
    4) support and development of national art and folk art (clause 7, article 7 of the Law of the Republic of Kazakhstan " on culture»);
    5) analysis of the language situation in the city (paragraph 3, article 25 of the Law of the Republic of Kazakhstan " on languages in the Republic of Kazakhstan»);
    6) carrying out activities for the development of languages of all ethnic groups, national traditions, customs of peoples (article 17 of the Law of the Republic of Kazakhstan " on languages in the Republic of Kazakhstan»);
    7) meeting the spiritual needs of the hearing-impaired, creating the necessary conditions for the development of folk art of the hearing-impaired and introducing new forms of leisure for the hearing-impaired (article 27 of the Law of the Republic of Kazakhstan " on culture»);
    8) within its competence, resolving issues related to capital and current repairs of cultural objects of the city (paragraph 7, article 9 of the Law of the Republic of Kazakhstan " on culture»);
    9) ensuring interaction with state and public associations in matters of ensuring compliance with the Law "on languages in the Republic of Kazakhstan" of July 11, 1997, the Law "on culture" of December 15, 2006, the Resolution "on the protection of historical and cultural monuments" of March 01, 2001, implementation of the State program for the functioning and development of languages;
    10) providing practical assistance to state bodies, public associations, enterprises, regardless of their ownership forms, in the implementation of the State program for the functioning and development of languages, organization of teaching the state language to different age groups of the population (paragraph 5, article 25 of the Law of the Republic of Kazakhstan " on languages in the Republic of Kazakhstan»);
    11) rendering assistance to state bodies, public associations, enterprises, regardless of their ownership forms, in registration of details and visual information in accordance with the requirements of the Law "on languages in the Republic of Kazakhstan" of July 11, 1997 within its competence (article 21 of the Law of the Republic of Kazakhstan " on languages in the Republic of Kazakhstan»);
    12) organization of the work of the onomastic Commission under the mayor's office of the city (article 25-1 of the Law of the Republic of Kazakhstan "on languages in the Republic of Kazakhstan").
    16. Functions:
    1) Functions of the Department:
    1) organization of work on realization of state policy in the field of culture and development of languages (paragraph 7, article 7 of the Law of the Republic of Kazakhstan "On culture" and paragraph 1, article 25 of the Law of the Republic of Kazakhstan "On languages in the Republic of Kazakhstan»);
    2) formation of the budget and its targeted execution, control over the provision of paid services by enterprises, cultural institutions in accordance with the legislation of the Republic of Kazakhstan (article 75 of the Budget code of the Republic of Kazakhstan);
    3) control over the expenditure of funds aimed at financing the main activities of cultural institutions, state programs in the field of culture and language policy (Budget code of the Republic of Kazakhstan);
    4) control over the work of cultural institutions for the development of various forms of leisure activities of the population (paragraph 1, article 9 of the Law of the Republic of Kazakhstan " on culture»);
    5) interaction with other state institutions in the implementation of language legislation, in the preparation and conduct of cultural events aimed at promoting and developing the state language (paragraph 2, article 25-3 of the Law of the Republic of Kazakhstan " on languages in the Republic of Kazakhstan»);
    6) making proposals to the authorized body on management of municipal property, by definition, subject matter and purpose of state enterprises, and the definition of state enterprises (on the right of economic management or public enterprise) engaged in such activities (paragraph 6, article 9 of the Law of the Republic of Kazakhstan "On culture»);
    7) control over the use and safety of property of municipal legal entities, implementation of development plans by municipal state enterprises (paragraph 6, article 9 of the Law of the Republic of Kazakhstan " on culture»);
    8) approval of the Charter (Regulations) of municipal state institutions, making changes and additions to it (the Law of the Republic of Kazakhstan "on state property»);
    9) approval of financing plans for public utilities (item 1, article 85 of the Budget code of the Republic of Kazakhstan);

    5) organization of work on accounting, protection and use of historical and cultural heritage (article 25 of the Law of the Republic of Kazakhstan " on culture»);
    6) organization of work on the implementation of the state language policy, regional language development program (article 25-3 of the Law of the Republic of Kazakhstan " on languages in the Republic of Kazakhstan»);
    7) assistance in holding cultural events with the involvement of ethnic and cultural centers (article 27 of the Law of the Republic of Kazakhstan " on culture»);
  2. 17. Rights and obligations:
    1) request in accordance with the established procedure from state bodies and officials, other organizations and citizens information necessary for the performance of their functions, organize the participation of employees of state bodies and other organizations in the preparation of issues related to the competence of the Department and conduct activities in the implementation of state policy in the field of culture and language development (article 9 of the Law of the Republic of Kazakhstan "on culture", article 25 of the Law of the Republic of Kazakhstan " on languages in the Republic of Kazakhstan»);
    2) make proposals to the mayor of the city to improve the organization of institutions in the field of culture and language development, prepare information, analytical and other materials on issues related to the Department (article 9 of the Law of the Republic of Kazakhstan "on culture", article 25 of the Law of the Republic of Kazakhstan " on languages in the Republic of Kazakhstan»);
    3) interact with state bodies, public associations, enterprises, regardless of ownership, in the implementation of language legislation in the preparation and conduct of cultural events aimed at promoting and developing the state language (paragraph 1, article 25 of the Law of the Republic of Kazakhstan " on languages in the Republic of Kazakhstan»);
    4) organize seminars, meetings, conferences on language policy and culture, participate in similar forums of various institutions, bodies, public associations at the city, regional and national levels (paragraph 2, article 27 of the Law of the Republic of Kazakhstan "on culture", article 25-3 of the Law of the Republic of Kazakhstan " on languages in the Republic of Kazakhstan»);
    5) consider in accordance with the established procedure letters and complaints of the population, organization of reception of citizens on personal issues (article 16 of the Law of the Republic of Kazakhstan " on administrative procedures»);
    6) issue orders, instructions and other acts based on and in compliance with the Law "on languages in the Republic of Kazakhstan", the Law "on culture", the State program "Cultural heritage", presidential Decrees, Government resolutions, decisions and orders of the mayor of the city on this issue (article 5 of the Law of the Republic of Kazakhstan " on administrative procedures»);
    Organization of the state body's activities
    The leadership of the state institution "Department of culture and languages development of Balkhash town" by the first head, who bears personal responsibility for performance assigned to state institution "Department of culture and languages development of Balkhash town" tasks and the exercise of its functions.
    19. the First head of the state institution "Department of culture and language development of the city of Balkhash" is appointed and dismissed by the higher authorized body in accordance with the legislation of the Republic of Kazakhstan.
    20. Powers of the first head of the state institution "Department of culture and language development of the city of Balkhash" (hereinafter-the Department):
    1) organizes anti-corruption activities and is personally responsible for their implementation;
    2) manages the activities of the Department and is responsible for performing the tasks assigned to the Department;
    3) carries out distribution of functional duties among the officers of the Department;
    4) approve the regulations on the structural divisions of the Department, define their functions and powers;
    5) regulates the interaction of structural divisions of the Department;
    6) arranges the placement of personnel and makes proposals on the structure and staffing of the Department and the network of subordinate cultural institutions;
    7) within the approved number of employees, the remuneration Fund approves the staff schedule of the Department and the network of subordinate cultural institutions;
    8) within the competence of the chief issues orders on the basis of current Laws, monitors the implementation of decisions, orders of the Government of the Republic of Kazakhstan, the city akimat;
    9) approves strategic and current plans;
    10) imposes disciplinary penalties on employees of the Department in accordance with the procedure established by law;
    11) in accordance with the procedure established by law, provides incentives to employees of the Department;
    12) issue orders, give instructions, and sign official documents within its competence;
    13) represents the state institution "Department of culture and language development of the city of Balkhash" in state bodies and other organizations;
    14) exercise other powers in accordance with the law.
    The powers of the first head of the state institution "Department of culture and language development of the city of Balkhash" during his absence are performed by a person who replaces him in accordance with the current legislation.
    Property of a state body
    The state institution "Department of culture and language development of the city of Balkhash" may have separate property on the right of operational management in cases stipulated by law.
    Property of state institution "Department of culture and languages development of Balkhash town" is formed at the expense of the property transferred to it by the owner and property (including cash income), acquired as a result of its own activities and other sources not prohibited by the legislation of the Republic of Kazakhstan.

    Reorganization and abolition of a state body
    The reorganization and abolition of the state institution "Department of culture and language development of the city of Balkhash" is carried out in accordance with the legislation of the Republic of Kazakhstan.
