The state institution" Department of state assets and purchases of the city of Balkhash " is a state body of the Republic of Kazakhstan, which is responsible for managing district (city) municipal property, organizing and conducting unified state purchases of goods, works and services.
The state institution" Department of state assets and purchases of Balkhash city " carries out its activities in accordance with the Constitution and laws of the Republic of Kazakhstan, acts of the President and Government of the Republic of Kazakhstan, other regulatory legal acts, as well as this Regulation.
State institution" management of state assets and procurement of Balkhash town " is a legal entity in organizational-legal form of state establishment, has seals and stamps with its name in state language, forms of the established sample in accordance with the legislation of the Republic of Kazakhstan accounts in the Treasury bodies.

Mission, main tasks, functions, rights and responsibilities
The mission of the state institution" Department of state assets and purchases of the city of Balkhash": organization and conduct of unified state purchases of goods, works and services, analysis and monitoring of public procurement carried out by state bodies, institutions and enterprises, ensuring effective and efficient management of municipal property, accounting, storage, evaluation and sale of property received in municipal ownership.
Tasks:
1) ensuring the organization and conduct of centralized public procurement in accordance with the list of goods, works and services determined by the authorized body (article 8 of the Law of the Republic of Kazakhstan "on public procurement");)»);
2) ensuring rational and economical spending of budget funds in the organization of public procurement;
3) ensuring the implementation of the state policy in the field of management of district (city) communal property in accordance with the Law of the Republic of Kazakhstan dated March 1, 2011 "on state property" (hereinafter – the Law).);
4) other tasks assigned to it by the current legislation of the Republic of Kazakhstan.
Functions:
1) ensuring the organization and conduct of centralized public procurement in accordance with the list of goods, works and services determined by the authorized body (article 8 of the Law of the Republic of Kazakhstan "on public procurement");)»);
2) analysis and monitoring of public procurement of goods, works and services carried out by state bodies, institutions and enterprises;
3) Development within its competence of draft normative and legal acts regulating relations in the field of public procurement and management of district (city) municipal property;
4) carrying out competition by definition periodicals for publication of the notice of bidding for the privatization of municipal property in accordance with the Law of the Republic of Kazakhstan "On public procurement" (paragraph 5 of article 18 of the Law of RK "On state property");)»);
5) transfer of municipal property to a property hiring (the lease), confidential management to physical persons and non-state legal entities without a right of subsequent redemption, with a right to repurchase or a right of subsequent transfer of ownership to small businesses on a Pro Bono basis (paragraph 6 of article 18 of the Law of RK "On state property"););»);

Rights and obligations of the state institution " Department of state assets and purchases of the city of Balkhash"»:
1) within its competence to request and receive from state bodies, legal entities with the participation of the state and other organizations and individuals the necessary information and documents (Law of the Republic of Kazakhstan "on administrative procedures", article 1, paragraph 2-1);););
2) to involve specialists of local Executive bodies, as well as independent experts to conduct economic expertise and consultations (Budget code of the Republic of Kazakhstan, Article 154, paragraph 6);););
3) sending to the mayor's office of the city information about the conduct of competitive procedures in the course of monitoring the implementation of public procurement;
4) preparation and provision of information and analytical materials to state bodies within their competence in coordination with the supervising Deputy mayor of the city (Law of the Republic of Kazakhstan "on administrative procedures", article 1, paragraph 2-1));
5) exercise of other powers defined by the legislation of the Republic of Kazakhstan (the Law of the Republic of Kazakhstan "on local state administration and self-government", article 31, paragraph 2).

3) acts on the principles of unity of command and independently solves issues of activity of the state institution in accordance with its competence, defined by the legislation of the Republic of Kazakhstan and this Regulation;;
4) acts on behalf of a state institution without a power of attorney and represents It in all organizations;;;
5) opens Bank accounts;

7) approve the procedure and plans of the Department for business trips, internships, training of employees in Kazakhstan and foreign training centers and other types of professional development of employees;;;
8) defines the duties and powers of chief specialists and other employees of the Department, approves job descriptions of employees of the Department; ;;
9) issue orders within its competence; ;
10) in accordance with the legislation of the Republic of Kazakhstan, appoint and dismiss employees of the Department;; ;
11) in accordance with the procedure established by law, encourages and imposes disciplinary penalties on employees of the Department;;;
12) signs the Department's acts.
Property of a state body
The state institution" Department of state assets and purchases of state assets of the city of Balkhash " may have separate property on the right of operational management in cases stipulated by law. The property of the state institution" Department of state assets and purchases of the city of Balkhash " is formed at the expense of property transferred to it by the owner, as well as property (including monetary income) acquired as a result of its own activities and other sources not prohibited by the legislation of the Republic of Kazakhstan.

24. a state body may not independently alienate or otherwise dispose of the property assigned to it and the property acquired at the expense of funds issued to it under the financing plan, unless otherwise established by law.
