The state institution" Apparatus of the mayor of Sayak village " is a state institution that provides the activities of the mayor of the village, performing other functions provided for by the legislation of the Republic of Kazakhstan.
The state institution "Apparatus of akim of Sayak village" carries out its activities in accordance with the Constitution and laws of the Republic of Kazakhstan, acts of the President and Government of the Republic of Kazakhstan, other normative legal acts, as well as the Regulations on the apparatus of akim of the village.
State institution "Apparatus of akim of Sayak village" is a legal entity in the organizational and legal form of a state institution, has seals and stamps with its name in the state language, forms of the established sample, in accordance with the legislation of the Republic of Kazakhstan accounts in the Treasury bodies.
The state institution "Apparatus of the mayor of Sayak village" enters into civil relations on its own behalf.
13. the state institution "apparatus of the mayor of Sayak village" is prohibited to enter into contractual relations with business entities for the purpose of performing duties that are the functions of the state institution "Apparatus of the mayor of Sayak village".
The regulations on the apparatus of the mayor of Sayak village and its structure are approved by the akimat of Balkhash.

The state institution "Apparatus of akim of Sayak village" is formed,abolished and reorganized by the akimat of Balkhash city.
The office of the mayor of Sayak village is a state institution maintained at the expense of the local budget.
The state institution "apparatus of the mayor of Sayak village" is prohibited from entering into contractual relations with business entities in order to perform duties that are functions of the apparatus of the mayor of Sayak village.
The main tasks, functions, rights and responsibilities of the state institution "Apparatus of the mayor of Sayak village".
Tasks:
Information and analytical, organizational and legal, material and technical support of the activities of the mayor, as well as the solution of local issues.
Functions:
12.1. the office of the mayor of Sayak village within its competence:
1) ensure the organization of a local community meeting, a separate meeting of the local community of villagers, streets, apartment buildings, local community meetings;;
2) inform through mass media or other means about the time, place of convocation of the meeting of the local community and the issues discussed no later than ten calendar days before the day of their holding.;
3) ensures the implementation of decisions taken at a local community meeting or meeting of the local community and approved by the mayor of the village;
4) ensures planning and execution of the village budget;;
5) submit a report on the implementation of the village budget to the Assembly of the local community and the maslikhat of Balkhash; ;
6) decides on the implementation of the village budget;;
7) develop and submit to the local community Assembly for approval a program for the development of the local community;;
8) acts as a customer for the construction, reconstruction and repair of objects related to the communal property of the village;;
9) exercise control over the targeted and effective use of municipal property of local self-government;;;
10) exercise the rights of a subject of communal property in relation to municipal legal entities of local self-government;;
11) sets the term for maintaining and ensuring the safety of property received before the transfer to a municipal state enterprise (municipal property of local self-government), whose property is in the communal property of the settlement, to another person with subsequent write-off from the balance sheet;;;
12) represents the interests of the state on issues of municipal property of local self-government, protects the right of ownership (municipal property of local self-government) of the settlement;;);
13) exercise control over the performance by the Trustee of obligations under the contract of trust management of municipal property of local self-government;;
14) monitors and analyzes the implementation of development plans of municipal state enterprises, the property of which is in the communal property of the village (in the communal property of local government);));
15) organize accounting of municipal property of local self-government, ensure its effective use;;;
12.2. the office of the mayor of Sayak village in agreement with the local community meeting:
1) develop draft legal acts in the field of municipal property management of local self-government within its competence;;;
2) manages municipal property of local self-government, takes measures to protect it, unless otherwise provided by the laws of the Republic of Kazakhstan;;
3) make and implement a decision on the privatization of municipal property of local self-government, including ensuring its safety in the process of preparing the object for privatization, attract an intermediary to organize the privatization process, assess the object of privatization, prepare and conclude contracts for the sale of the object of privatization and monitor compliance with the terms of contracts for the sale of the object of privatization;;
4) determine the subject and purpose of state enterprises whose property is located in the communal property of the village (communal ownership of local self-government) and type of utility state enterprises engaged in such activities (on the right of economic management or public enterprise);;;
5) withdraw or redistribute property transferred to a municipal legal entity of local self-government or acquired by it as a result of its own economic activity;;
6) withdraw excess, unused or misused property of municipal legal entities of local self-government;;
7) provides municipal property of local self-government for property lease( lease), trust management to individuals and non-state legal entities without the right to subsequent redemption or with the right to subsequent redemption;;;
8) in agreement with the mayor of the city of Balkhash, make a decision to create, reorganize, change the name and liquidate municipal legal entities of local self-government;;;
9) gives consent to the municipal state enterprise to alienate or otherwise dispose of the property assigned to it (except for the sale of products produced by it), to establish branches and representative offices, as well as to transfer and write off accounts receivable;;;
10) approve the Charter (regulations) of state legal entities of local self-government, making changes and additions to it;; ;
11) determines the priority areas of activity and mandatory amounts of works (services) financed from the budget of municipal state enterprises whose property is in the communal ownership (municipal property of local self-government) of the settlement;;);
12) review, approve, in cases stipulated by the Law of the Republic of Kazakhstan "on state property", and approve development plans of state enterprises whose property is in the communal property of the village (municipal property of local government), and reports on their implementation;;;
13) make decisions on the use of municipal property of local self-government, including the transfer of its pledge, lease, gratuitous use and trust management;;;
14) assigns municipal property of local self-government to municipal legal entities of local self-government;;
15) makes a decision on alienation of municipal property of local self-government;;
16) exercise other powers provided by the legislation of the Republic of Kazakhstan.
The office of the mayor of Sayak village has the right, within its competence:
1) request and receive from officials of state bodies and other organizations the necessary information, documents and other materials;;;
2) acquisition and exercise of property and non-property rights;;;
3) use information databases of public administration bodies, archives, and scientific institutions;;;
4) conclude contracts and agreements;;
5) have other rights provided for in accordance with the legislation of the Republic of Kazakhstan.
Tasks of the state institution "Apparatus of the mayor of Sayak village":
1) quality provision of public services to the population in accordance with current legislation; ;
2) perform acts and instructions of the President, the Government of the Republic of Kazakhstan and other Central Executive bodies, the akim and akimat of the region, district (city of regional significance) in a high-quality and timely manner.
3) performing other tasks stipulated by the current legislation.
Organization of activity of state institution" akim's Apparatus of the village Sayak"
State institution" akim's Apparatus of the village Sayak " is headed by a Governor.
The mayor of the village is elected for a term of four years from candidates who have not reached twenty-five years, submitted by the mayor of Balkhash on an alternative basis and agreed with the Assembly of the local community. The mayor of the village is dismissed from the position of the mayor of Balkhash with the consent of the local community and the akim of the region.
Powers of the mayor:
1) is an official of the office of the mayor of Sayak village and without a power of attorney acts on his behalf in relations with state bodies, organizations and citizens;;;
2) consider appeals, applications, complaints of citizens, take measures to protect the rights and freedoms of citizens;;
3) contributes to the collection of taxes and other mandatory payments to the budget;;
4) promotes the implementation by citizens and legal entities of the norms of the Constitution of the Republic of Kazakhstan, laws, acts of the President and Government of the Republic of Kazakhstan, normative legal acts of Central and local state bodies;;;
5) regulate land relations within its competence; ;
6) ensures the preservation of the communal housing stock of the village, as well as the construction, reconstruction, repair and maintenance of highways in the village;;;
7) contributes to the organization of peasant or farm farms, the development of business activities;;
8) within its competence, organizes and ensures the implementation of the legislation of the Republic of Kazakhstan on military duty and military service, mobilization training and mobilization, as well as civil protection;;;
9) organizes notarial actions, registration of civil status acts in accordance with the procedure established by the legislation of the Republic of Kazakhstan;;;
10) determines the unemployed in accordance with the procedure established by the legislation of the Republic of Kazakhstan;
11) organizes work on the preservation of historical and cultural heritage;;;
12) identifies low-income individuals, submits proposals to higher authorities for employment, providing targeted social assistance, organizes services for the elderly and disabled at home, coordinates the provision of charitable assistance to them;;;
14) organizes assistance to persons with disabilities;;
15) organizes public works, youth practice and social work places;;;
16) organize together with the authorized body for physical culture and sports and public associations of disabled people health and sports events among the disabled;;;
17) organizes mass cultural and educational events jointly with public associations of disabled people.;
18) coordinates the provision of charitable and social assistance to the disabled;;;
19) promotes the development of local social infrastructure; ;
20) in case of emergency medical care, arrange for the delivery of patients to the nearest health organization providing medical care;;
21) interacts with local self-government bodies;
22) participates in the sessions of the maslikhat of the city when approving (clarifying) the local budget;;
23) organize water supply to localities within its competence and regulate water use issues;;
24) organizes works on improvement, lighting, gardening and sanitary cleaning of settlements;;
25) organize the burial of rootless people and public works for the maintenance of cemeteries and other burial places in proper condition.
26) organizes work on prevention of corruption;
27) creates infrastructure for sports activities of individuals at their place of residence and in places of their mass recreation;;
28) provides the municipal property transferred to management for property hire (lease) to individuals and non-state legal entities without the right of subsequent redemption;;;
29) determines priority areas of activity and mandatory amounts of work (services) financed from the budget, transferred to public utilities of state enterprises;;
30) ensures the safety of the transferred communal property;;
31) approve the annual financial statements of the state-owned utility enterprise transferred to Management, approved by the decision of the local Executive body.;
32) sets prices for goods (works, services) produced and sold by state-owned municipal enterprises transferred to management;
33) organizes the work of the akim's office, manages its activities;;
34) review decisions made at a local community meeting or meeting of the local community, and ensure their implementation;;
35) accepts employees under an employment contract at the expense of saving budget funds and (or) revenues provided for by the legislation of the Republic of Kazakhstan On local government and self-government;;
36) draw up and approve a consolidated plan of receipts and expenditures of money from the sale by state institutions of goods (works, services) remaining at their disposal, in accordance with the budget legislation of the Republic of Kazakhstan;;;
37) conducts an inventory of the housing stock of the village;
38) organizes the demolition of emergency housing in the village in agreement with the mayor of the city and the local community meeting;;;
39) promotes micro-credit to the rural population within the framework of program documents of the state planning system.
40) keeps economic records in accordance with the list approved by the authorized body in the field of state statistics and statistical methodology;;;
41) organize the maintenance of registration records in the form approved by the authorized body in the field of state statistics;;;
42) ensures the accuracy of economic accounting data;;
43) exercise other powers in accordance with the legislation of the Republic of Kazakhstan on issues related to its competence.
The mayor may have a Deputy mayor in accordance with the legislation of the Republic of Kazakhstan.
The mayor determines the duties and powers of the Deputy mayor in accordance with the legislative acts of the Republic of Kazakhstan.
The mayor ensures that the staff of the village mayor's office comply with the norms of ethics of civil servants.
Property of the state institution "Apparatus of akim of Sayak village"
The state institution" Apparatus of the mayor of Sayak village " may have separate property on the right of operational management in cases stipulated by law.
The property of the village akim's office is formed at the expense of the property transferred to it by the owner, as well as property (including monetary income) acquired as a result of its own activities and other sources not prohibited by the legislation of the Republic of Kazakhstan.
The property assigned to the office of the mayor of the village belongs to the communal property of the village of Sayak (local government).
The state institution" Apparatus of the mayor of Sayak village ", in agreement with the Assembly of the local community, may alienate or otherwise dispose of the property assigned to it and the property acquired at the expense of funds issued to it under the financing plan, unless otherwise established by law.
Reorganization and abolition of the state institution "Apparatus of akim of Sayak village"
Reorganization and abolition of the state institution "Apparatus of akim of Sayak village" are carried out in accordance with the legislation of the Republic of Kazakhstan.
