Regarding the draft Government resolution providing for amendments to the regulations of the Ministry of Information and Social Development of the Republic of Kazakhstan

Currently, a draft Government decree is being discussed in some media and social networks, providing for amendments to the Regulations of the Ministry of Information and Social Development of the Republic of Kazakhstan.

The project was developed in order to bring the Ministry's Regulations into line with the draft law "On Amendments and Additions to Some Legislative Acts of the Republic of Kazakhstan on the protection of children's rights, education, information and informatization".

First of all, it should be noted that the draft law "On amendments and additions to some legislative acts of the Republic of Kazakhstan on the protection of children's rights, education, information and informatization" is under consideration in the Senate of the Parliament of the Republic of Kazakhstan.

In this regard, taking into account the requirements of the law "On Legal Acts", as well as the Regulations of the Government, the draft resolution was posted on the portal "Open RLAs" to receive comments from the public.

It should be noted that the legislative regulation of cyberbullying is aimed at providing measures and mechanisms for prompt and rapid response to citizens' appeals concerning the safety of children.

The draft law assumes that if there are facts of cyberbullying against minors, an order will be sent to online platforms and instant messaging services to take measures to delete information that violates the rights of minors.

In order to interact with the authorized body, online platforms and instant messaging services, their owners will need to identify their representatives within 6 months from the date of entry into force of the law.

These representatives will take measures to remove content related to the facts of cyberbullying of minors.

In fact, the amendments provided for by the draft law will not adversely affect ordinary users, except in cases when their actions will fall under the qualification of cyberbullying.

Currently, foreign social networks are already working to identify and appoint a legal representative.

In addition, it should be emphasized that following the consideration of the draft law by the Senate of the Parliament, amendments and additions may be made to it. Accordingly, the draft Government decree will also be amended, and the final version of this draft will also be posted on the Open RLAs portal for discussion.
