In 2020, the Law of the Republic of Kazakhstan "On the procedure for organizing and holding peaceful assemblies in the Republic of Kazakhstan" was adopted.
A peaceful assembly is understood as a public event that carries the following signs:
- peaceful nature;
- nonviolent and unarmed;
- does not pose a threat to the interests of state security, public order, health protection, protection of public morals, rights and freedoms of other persons;
- held in the form of meetings, rallies and demonstrations, processions and picketing by citizens of the Republic of Kazakhstan.
In accordance with this Law, a notification procedure is provided for the organization and conduct of meetings, rallies and pickets.
The organizer submits a notification to the local executive body 5 working days before the day of their holding, which must consider it within three working days.
If there is no response after this period, the organizer holds a peaceful meeting. A conciliatory procedure has been established for demonstrations and processions. The application is submitted ten working days before the day of the event.
The local executive body is obliged to give a response within seven working days. During this time, the organizer and the local executive body create conditions for organizing and safely holding peaceful assemblies, protecting the health of their participants.
It should be noted that peaceful assemblies should be held in specialized places.
For organizing and participating in peaceful assemblies held in violation of the established procedure, liability is provided under article 488 of the Code of Administrative Offenses with a penalty up to arrest for 15 days.
If these actions are accompanied by significant harm to the rights and legitimate interests of citizens, organizations, society or the state, criminal liability ensues, providing for punishment in the form of arrest for up to fifty days (Article 400 of the Criminal Code).
