"Protection of the rights of entrepreneurs"

One of the main tasks of the prosecutor's office is to protect the rights of business entities.

Over the past period of this year, the Main Transport Prosecutor's Office has protected the rights of 1,142 entrepreneurs.

For example, the audit revealed facts of abuse of the dominant monopoly position of JSC NC "Kazakhstan Temir Zholy" (hereinafter – KTZ).

KTZ has formed special tariff conditions for transit transportation of goods with a decreasing coefficient.

At the same time, for organizations belonging to the KTZ group, a lowering coefficient was applied from the moment of conclusion of the contract.

In turn, with respect to other business entities, such discounts were provided only after the guaranteed volume of transportation was completed.

Such unequal conditions allowed organizations belonging to the KTZ group to significantly reduce their tariffs and gain an advantage over others.

According to the act of supervision of the Main Transport Prosecutor's Office on February 15 of this year, KTZ made appropriate changes to the internal rules regarding the application of special tariff conditions after the guaranteed volume of transportation to all subjects.
