At the protest of the Main Transport Prosecutor's Office, the order of the Transport Committee was canceled, which instructed all the territorial bodies of the Committee, together with the branches of JSC "NC "Kazakhstan Temir Zholy", to examine railway stations for their compliance with the National Standards of the Republic of Kazakhstan.
In the course of these activities, transport inspectors planned to examine life support systems, engineering protection and other issues related to the operation of 58 railway stations across the country.
However, according to the requirements of the current legislation, the conduct of such a survey is not within the competence of the transport control authorities.
Moreover, the Business Code, which regulates legal relations in the field of state control, does not contain the concept of "survey".
In other words, the Transport Committee, under the guise of surveys, planned full-fledged inspections of a number of organizations, including private business entities, without having the authority and grounds to do so.
The Head of State has repeatedly noted the inadmissibility of illegal interference of regulatory authorities in the activities of state structures and business entities.
In such circumstances, the actions of the Transport Committee are unacceptable.
Thus, the Main Transport Prosecutor's Office stopped an attempt to conduct state control by canceling an illegal order.
Currently, work in this direction continues, other measures are being taken to identify and suppress the facts of illegal interference in the activities of entrepreneurs.
