One of the main tasks of pre-trial investigation bodies is to take measures to compensate for damage caused by a criminal offense.
For this purpose, during the supervision of the legality of the criminal process, transport prosecutors ensure the identification of stolen items and money, as well as the property of suspected persons, tools and means of committing crimes.
As a result of this work, in 2019, the victims were compensated for damages in the amount of more than 1 billion tenge, of which about 800 million tenge in the interests of the state, which is 5 times more than in 2018.
Also, contraband goods worth 1 billion 700 million tenge were converted to the state revenue.
For example, in 2019, special prosecutors of the Main transport Prosecutor's office sent a criminal case to the court against 11 individuals who, under the patronage of customs officers, were involved in smuggling "cigarettes and tires" on a particularly large scale from the United Arab Emirates as part of an organized criminal group.
In this case, on 31.12.2019, a verdict of guilty was passed by the Specialized inter-district court for criminal cases of the Mangistau region. Contraband goods worth 1 billion 400 million tenge were confiscated to the state revenue.
It should be noted that since July 1, 2018, the provisions of The law "on the victims 'compensation Fund" have been put into effect, which gave the courts the right to collect compulsory payments from convicted persons in favor of this Fund.
As of today, more than 18.3 million tenge has been collected in transport cases, of which 11.3 million has been paid voluntarily, 3.6 million has been forcibly paid, and about 3 million has been executed.
Starting from July 1 this year, funds from the Fund will be issued as a one-time financial compensation. The amount of payment is from 30 to 50 MCI.
Compensation will be paid to the victims of trafficking or torture, minor sexual abuse victims, persons who suffered serious bodily harm (including HIV), legal representatives in case of death of the victim (just a list provided by 124 of the offense for 46 articles of the Criminal code).
