The main transport Prosecutor's office has strengthened its work to identify circumstances that contribute to the Commission of criminal offenses.
This duty is assigned to investigators who, during the investigation of criminal cases, have the right to make representations on the elimination of violations of the law.
When coordinating the GTR, in 2019, the Prosecutor's office and criminal prosecution authorities made 1,112 submissions, which is 10% more than in 2018.
On the same grounds, the courts issued 26 private decisions, 13 of them were at the request of state prosecutors.
According to the results of their consideration, about 240 persons were brought to disciplinary responsibility, 5 - to administrative responsibility, 25 employees were terminated their employment contracts, and 730 legal explanatory events were held.
These decisions were made due to various factors: violation of the rules for passenger and baggage transportation, inadequate departmental control over security structures, lack of video surveillance cameras, lack of lighting, proper control over "registered" persons, and much more.
For example, the Semey transport Prosecutor's office during the study of the criminal case found that a stolen mobile phone worth 60 thousand tenge was accepted by a pawnshop as collateral for a loan of 10 thousand tenge.
It turned out that the pawnshop employee, without checking the availability of title documents on the phone, provided the criminal with the opportunity to sell stolen property.
The authorized body conducts a corresponding check on this fact.
Shusky and Druzhbinsky transport prosecutors found that the theft of the phone and other personal items on the train were committed by "stowaways". The guilty guides were brought to administrative responsibility. The KTZ has submitted a proposal to strengthen preventive measures.
The Kokshetau transport Prosecutor's office revealed the fact of improper probation control over a "registered" person – a dangerous recidivist, who on December 18, 2019, at night, in a state of alcoholic intoxication, was detained at the scene of a robbery as part of a group of persons.
The study of the materials of the probation service showed that this recidivist had been brought to administrative responsibility 12 times before this case, and was released from criminal liability 5 times in connection with the reconciliation of the parties.
The second suspect was also on probation as a multiple offender of crimes against property (theft, robbery).
The transport Prosecutor's office is considering registering a pre-trial investigation against employees of the internal Affairs bodies on grounds of inaction and negligence in the service.
