I ORDER:
The following amendments shall be made to Order No. 207 of the Minister of Finance of the Republic of Kazakhstan dated March 26, 2015, "On Approval of the Rules for Maintaining the State Property Register, Including the Procedure for Interaction between State Agencies and the Provision of Information Therefrom to Users" (registered in the Register of State Registration of Regulatory Legal Acts under No. 10801):
To the Rules for Maintaining the State Property Register, Including the Procedure for Interaction between State Agencies and the Provision of Information Therefrom to Users, approved by this order:
Supplement paragraph 6 with subparagraph 9-1) as follows:
"9-1) objects in the form of subsoil and subsoil use rights to groundwater, hydrocarbon minerals (hydrocarbons), and solid minerals (including information from the unified cadastre of the state subsoil fund, compiled in the unified subsoil use platform on the registry web portal);";
Supplement paragraph 10-1 with the following content:
"10-1. In order to maintain the state property register, state bodies shall implement the following functions:
1) drafting and signing transfer deeds, as well as separation, interim liquidation, and liquidation balance sheets during the reorganization and liquidation of state-owned legal entities in accordance with Appendix 1 to these Rules;
2) approving the charters of state-owned enterprises with the right of economic management and operational management, amendments, and additions thereto upon submission by authorized bodies of the relevant industry, in accordance with Appendix 2 to these Rules;
3) redistribution of the property of a liquidated state-owned legal entity remaining after the satisfaction of creditors' claims, in accordance with Appendix 3 to these Rules;
4) coordinating draft resolutions proposed for adoption at general meetings of shareholders (participants in limited liability partnerships) of joint-stock companies (limited liability partnerships) with state participation, in accordance with Appendix 4 to these Rules;
5) Granting consent to a state-owned enterprise with the right of economic management and operational management to establish branches (representative offices), in accordance with Appendix 5 to these Rules;
6) Coordinating the reorganization and liquidation of a state-owned enterprise with the right of economic management and operational management, in accordance with Appendix 6 to these Rules;
7) Seizure or redistribution of property transferred to a republican state legal entity or acquired by it as a result of its own economic activities, in accordance with Appendix 7 to these Rules;
8) Reflecting information on the accrual of dividends on state-owned shares and their payment, as well as the distribution of net income among the participants of a limited liability partnership, in accordance with Appendix 8 to these Rules;
9) Compiling and maintaining a list of state-owned property applications, in accordance with Appendix 9 to these Rules. Supplement with Appendices 1, 2, 3, 4, 5, 6, 7, 8, and 9 in accordance with Appendices 1, 2, 3, 4, 5, 6, 7, 8, and 9 to this order.
The State Property and Privatization Committee of the Ministry of Finance of the Republic of Kazakhstan, in accordance with the procedure established by the legislation of the Republic of Kazakhstan, shall ensure:
1) state registration of this order with the Ministry of Justice of the Republic of Kazakhstan;
2) posting of this order on the website of the Ministry of Finance of the Republic of Kazakhstan after the day of its first official publication;
3) within ten business days after the state registration of this order with the Ministry of Justice of the Republic of Kazakhstan, submission to the Department of Legal Service of the Ministry of Finance of the Republic of Kazakhstan of information on the implementation of the measures stipulated in subparagraphs 1) and 2) of this paragraph.
This order shall enter into force three months after the day of its first official publication.
