In its activities, the Department is guided by the Constitution of the Republic of Kazakhstan, the Civil Code of the Republic of Kazakhstan, the laws of the Republic of Kazakhstan "On State Property", "On Anti-Corruption", "On State Service", etc., acts of the President of the Republic of Kazakhstan and the Government of the Republic of Kazakhstan, other regulatory acts of the Ministry of Finance of the Republic of Kazakhstan, state property and decisions and orders of the Privatization Committee, orders and orders of the head of the Department. The specified regulatory acts meet the requirements of all established legal norms that raise issues related to the department's activities, and prevent the occurrence of corruption offenses.
Implementation of permissive functions.
In accordance with the Law of the Republic of Kazakhstan "On State Property" and the Regulation of the State Institution "Kyzylorda Department of State Property and Privatization to the Committee of State Property and Privatization of the Ministry of Finance of the Republic of Kazakhstan", approved by the order of the Acting Chairman of the Committee of State Property and Privatization of the Ministry of Finance of the Republic of Kazakhstan No. 934 of September 17, 2018, 17 orders for the transfer of property were issued by the end of 2024 republican state legal entities with balance on balance, composed of 21 acts of reception-peredachi. A total of 497 objects were transferred from the balance sheet to the balance sheet of republican state institutions. Of them, 486 properties, 6 vehicles, 5 buildings.
Since September 2019, the Committee of State Property and Privatization of the Ministry of Finance of the Republic of Kazakhstan transferred the following functions to the competence of the department:
transfer to communal ownership of property of republican state institutions, with the exception of property of central state bodies and their departments;
Issuance of consent to the transfer of property of communal legal entities on the balance sheet of republican state institutions to republican ownership, with the exception of transfer to the balance sheet of central state bodies and their departments.
In connection with this department, 20 orders were issued for the transfer of 421 properties from republican ownership to communal ownership. Of them, 385 properties, 21 motor vehicles, 15 properties were transferred to republican ownership, and 20 letter-agreements were concluded on the transfer of property from communal legal entities to republican ownership.
In accordance with the current legislation, the regulations of the department and the department within its competence, one of the main activities of the department is privatization, trust management and lease of property in republican ownership. In this regard, the department conducted the following internal analysis for the purpose of preventing corruption in 2024:
Identification of corruption risks in normative legal acts and organizational-management activities affecting the department's activities.
Regarding the privatization of republican state property:
When privatizing republican state property, objects provided by republican state institutions and enterprises are generally produced in accordance with the Rules for the sale of privatization objects, approved by Resolution of the Government of the Republic of Kazakhstan dated August 9, 2011 No. 920.
These rules describe in detail how documents for republican property subject to privatization are drawn up, the responsibility of the balance sheet holder until the moment of privatization is according to the presented forms, whether it is necessary to carry out work assignments after inclusion in the sales schedule to evaluate the evaluation companies-winners of state procurements in accordance with the current laws of the Republic of Kazakhstan on evaluation, etc. In addition, all these works are aimed at prevention of corruption, auctions are conducted openly in electronic form, are posted on the Internet at the address: www.gosreestr.kz.
In total, in 2024, the Department privatized 34 vehicles provided by republican state institutions and enterprises.
