I ORDER:
The following amendments shall be made to Order No. 207 of the Minister of Finance of the Republic of Kazakhstan dated March 26, 2015, "On Approval of the Rules for Maintaining the State Property Register" (registered in the State Register of Regulatory Legal Acts under No. 10801):
In the Rules for Maintaining the State Property Register, approved by this order:
Clause 11 shall be amended to read as follows:
"11. The register shall consist of two subsections: primary and secondary.
Registration in the register of state-owned information technology assets shall be carried out in relation to software, internet resources, and electronic information resources.
Owner government agencies (owners) submit to the single operator for inclusion in the registry:
scanned copies of documents confirming the state's property rights (including to the domain name of internet resources) and balance sheet item breakdowns for software and internet resources;
backup copies of the electronic information resource on removable media.
Backup copies of electronic information resources are updated daily through the integrated interaction of the government agency's information system with the registry.
Subparagraph 4) of paragraph 14 shall be amended to read as follows:
"4) information on quasi-public sector entities, their privatization and alienation, as well as spatial (geographical) data;"
paragraph 17-1 shall be amended to read as follows:
"17-1. The antimonopoly authority updates the register based on an analysis of the state of competition in commodity markets to determine the feasibility of state presence in the business environment. It enters information on the following market conditions into the register:
1) an assessment of the ability of private market participants to fully satisfy market needs based on consumer demand in the commodity market occupied by the organization/state enterprise;
2) determining the number of market participants operating in the commodity market, broken down by private market participants and the organization/state enterprise, to prevent duplication of activities;
3) assessing the impact of the organization/state enterprise's share on competition in the relevant commodity market.
Based on the processing of the antimonopoly authority's information, according to an algorithm jointly approved by the authorized and antimonopoly authorities, a list of organizations and state enterprises is automatically generated in the register, assigning them the following statuses:
1) retain in state ownership permanently/temporarily;
2) liquidate;
3) reorganize;
4) privatize;
5) a public-private partnership facility."
The State Property and Privatization Committee of the Ministry of Finance of the Republic of Kazakhstan, in accordance with the procedure established by the legislation of the Republic of Kazakhstan, shall ensure:
1) state registration of this order with the Ministry of Justice of the Republic of Kazakhstan;
2) posting of this order on the website of the Ministry of Finance of the Republic of Kazakhstan;
3) within ten business days of state registration of this order with the Ministry of Justice of the Republic of Kazakhstan, submission of information on the implementation of the measures stipulated in subparagraphs 1) and 2) of this paragraph to the Department of Legal Services of the Ministry of Finance of the Republic of Kazakhstan.
This order shall enter into force ten calendar days after the date of its first official publication.
