Associations of disabled people will be able to participate in state procurement only after inspection in database of the Ministry of Finance

Since the beginning of this year, the law of RK has entered into force with amendments on issues of state procurement and procurement of quasi-public sector entities.

Paragraph 3 of article 51 of the Law states that public associations of persons with disabilities of the Republic of Kazakhstan, producing goods and (or) supplying goods, performing work, providing services, are allowed to participate in state procurement after passing an inspection in the information system of the Ministry of Finance of the RK (web portal of state procurement).

It is necessary for public associations of disabled people of the Republic of Kazakhstan and (or) organizations established by public associations of disabled people of the Republic of Kazakhstan to specify the IIN of employees (worked) for the last 4 tax periods (four quarters) to pass the inspection in participation in the web portal of state procurement.

These data will be automatically checked in the information system of the Ministry of labour and social protection of population of RK and the response of compliance or non-compliance will be transmitted to the IS of the Ministry of Finance of RK. Currently, the integration of information systems of the two departments has been carried out.

An inspection is carried out for compliance with all the conditions provided for in subparagraph 11 of part one of article 394 of the Code of the Republic of Kazakhstan "On taxes and other obligatory payments to the budget" (Tax code).

In addition, the average number of persons with disabilities should be at least 51 per cent of the total number of employees, and wage costs for disabled people should be distributed – in public associations of disabled people – at least 51 per cent, in specialized organizations in which disabled people work for hearing, speech, vision – at least 35 per cent of the total wage costs.

Membership to public associations of disabled people of the Republic of Kazakhstan and (or) organizations, the founder of which are public associations of disabled people of the RK will be checked.

In connection with the amendments, now the Ministry of labour and social protection of population of RK will not form a List of public associations of disabled people of the Republic of Kazakhstan and organizations created by public associations of disabled people of the Republic of Kazakhstan, producing goods and (or) supplying goods, performing work, providing services. Since the order of the Minister of health care and social development of the RK dated December 29, 2015 № 1065 "On some issues of state procurement in public associations of disabled people of the Republic of Kazakhstan and organizations created by public associations of disabled people of the Republic of Kazakhstan" has become invalid.
