In the department of the probation service of the G.Musrepov district of the DUIS of the North Kazakhstan region, an open trial was held in a remote format against the convicted "K." on the replacement of the punishment in the form of restriction of liberty with deprivation of liberty. When registering, a conversation of a preventive nature was held with the convicted "K.", about the prevention of criminal and administrative offenses, and the procedure and conditions for serving a sentence in the form of restriction of freedom were explained to her. Also, the convicted "K." was notified under a signature with a schedule of appearance at the probation service department.
However, the convicted "K.", being aware of the order of serving her sentence, did not appear for registration in the OSP named after G.Musrepov, violated the duties assigned by the court and was brought to administrative responsibility. After repeated warnings, as well as preventive conversations, the convict did not draw proper conclusions for herself, since the listed violations are malicious and systematic, the district probation service sent materials to the court about replacing the restriction of liberty with imprisonment for the part of the sentence not served. According to Part 3 of Article 44 of the Criminal Code of the Republic of Kazakhstan, in case of malicious evasion from serving a sentence by a person sentenced to restriction of liberty, it is replaced by a punishment in the form of imprisonment for the same period.
At the hearing, the convicted "K." fully admitted her guilt, as well as the facts of violations of the order of serving her sentence. The court, having examined the case materials, satisfied the submission of the probation service, replacing the punishment in the form of restriction of liberty with imprisonment for an unserved term of 2 years 2 months 3 days.
Since the beginning of this year, 49 persons sentenced to punishment without isolation from society, registered with the probation service of the North Kazakhstan region for violating the conditions and procedure for serving their sentences have been sent to places of imprisonment.
