The duties of persons registered with the Probation Service, which ensure the execution of criminal penalties without isolation from society, are defined by a special law. For example, one of the tasks of a person in respect of whom probation control is established is to visit the Probation Service on the established days for registration and conducting a preventive interview with him or her, and to notify the Probation Service in writing about the change of place of residence, work or educational institution.
However, there are also often those who violate the procedure for performing such duties assigned to them by law. One of them is a citizen named A., who is registered with the Probation Service of Bostandyk District of Almaty. Convicted of a sentence in the form of restriction of Liberty, A. was obliged to register with the Probation Service Department twice a month in accordance with the registration schedule drawn up by probation specialists and come to conduct a preventive interview with him.
If he did not comply with this requirement, probation officers gave him a written warning to change the punishment in the form of restriction of liberty to imprisonment. Unfortunately, the defendant did not draw any conclusions from the written warning. He also changed his place of residence without notifying the Probation Service. Recently, the District Court No. 2 of Bostandyk District of Almaty, in accordance with paragraph 1 of Part 2 of Article 67 of the Criminal executive code of the Republic of Kazakhstan, transferred the unserved part of the punishment in the form of restriction of liberty to imprisonment for a convicted person.
