- Asset Serikovich, recently there has been a lot of talk in the legal sphere about the humanization of punishment. Both President N. Nazarbayev and President K. Tokayev often return to this topic and give special instructions to representatives of the legal sphere. How does this process work in the institution you run?
–A lot of work is being done in the country regarding the humanization of punishment. Since the adoption of the concept of legal policy of the Republic of Kazakhstan, the legal sphere in the country has undergone radical positive changes. Many laws have been improved, amendments and additions have been made. Constitutional, administrative, civil, Banking, Tax, Financial, Customs, environmental, criminal, Criminal Procedure, and criminal enforcement laws have been significantly updated, based on the principles of humanization, in accordance with the requirements of the world's legal reform. Such searches in the legal sphere were born with the goal of radical reform of national legislation, bringing it closer to the best international standards. In accordance with this, some articles of the Criminal Code of the Republic of Kazakhstan were transferred to the Administrative Code of the Republic of Kazakhstan. The scope of application of the mediation method has expanded. In general, although the humanization process is not directly related to pre-trial detention centers, the impact of such changes in the legal system is still felt. Humanization mainly directly affects those serving sentences in correctional institutions, rather than in pre-trial detention centers. We often have pre-trial detention. According to Article 92 of the Criminal Code of the Republic of Kazakhstan, citizens who have not previously had a criminal record have positive characteristics. They mainly carry out household work on the basis of such professions as plumber, plumber. If they meet the humanization requirements in all respects, they will definitely be included in the same category.
Also, recently, in accordance with the pandemic situation, we have been organizing video meetings. This event was a very positive solution, especially for residents of both regions and remote regions. They can communicate with our son, friend, brother, and wife through video communication, even if they are now sitting far away. In addition to the organization of supervision and control of the special contingent, the life of the institution consists of such regime activities as walking, bathing, search activities, technical inspection of cameras, receiving greetings, holding short-and long-term meetings, the release of a special contingent for meetings with lawyers and lawyers, as well as employees of pre-trial prosecution bodies.
At the same time, work is carried out on an ongoing basis on cooperation with other law enforcement agencies to solve minor and particularly serious crimes.
- Almaty is one of the largest megacities in the Republic. It is known that various crimes take place in this big city. In general,on what crimes do you get the most citizens? What are the most committed crimes in Almaty?
- The main task assigned by the state to law enforcement agencies from the very beginning is to protect the rights and freedoms of a person and citizens. According to the Constitution, all of us are guaranteed a free life. Therefore, in our society, no one is accused or arrested for no reason. Law enforcement officers only detain a suspect who has real evidence and close the investigation. If the court proves his crime, of course, he will be punished in accordance with the requirements of the law. However, despite the rapid process of humanization in the country, it is a pity that crimes do not decrease.
The number of special contingents in the LA-155/18 institution is 1400 seats. According to a court order, it is the largest special institution (pre-trial detention center) in the Republic for the detention of suspects and accused persons who have committed crimes.
Currently, the number of people held in the institution is about 1,300 people. The institution serves 21 city and 9 regional judicial and pre-trial investigation bodies. According to statistics, about 10,000 people pass through the year.
They have different categories and types. Recently, a lot of people have been falling under the article of fraud. There are enough people who cheat the country through various financial pyramids and take their money. Theft, robbery, murder, rape, distribution of narcotics, "builders" and many other crimes. The saddest thing is that a lot of young people and students are involved in this drug distribution business. The involvement of young people in this shadow business is not decreasing. Recently, one of your colleagues at Tengrinews interviewed such a person. Many of them are young people who are looking for education in remote regions. He wants to earn income on his own, get rich quickly, go for a walk, and say that he wants to keep a new smartphone. Then he communicates with "employers" through various ads from the Telegram. They tell him where to take the" product " and where to take it. They take pictures of this place and send it to them, they say that they will pay 1000 tenge for such a point. 90 percent of the ads that are pasted everywhere are such shady businesses. Drug enforcement agencies, together with the police, are currently investigating them.
There are many cases of fraud among women. Some people say that they committed a crime because of a difficult life, but for others it has become a "habit of life". Minors also come to us. They fall on very serious crimes (rape, murder).
- Tell us about the educational and regime work in the pre-trial detention center LA155/18. In general, there is no shortage of personnel?
"We have several departments. They work with educational work, issues of regime and security. The department, which is engaged in educational work, works with prisoners in several areas. Organizes sports and concert events, prepares for holidays. There will be a diary for every citizen. It records all works related to this citizen, which are written by employees of all departments.
How is the path of Correction of the convicted person carried out?
Three positive actions, three negative feedback actions are recorded, and work is carried out on them. A characteristic is given.
How is their disciplinary regime implemented?
Everything is recorded in the newly mentioned notebook. Specialists are looking in this direction, studying a person. Both the regime and Security Department and the Operational Department have an official function assigned to them. There is a slight shortage of personnel, but we are making efforts to ensure that the system as a whole works with the available personnel.
In order to strengthen quarantine measures and prevent infection of a special contingent of COVID-19 coronavirus infection, travel outside the facility has been suspended. In this regard, employees were assigned additional responsibilities for organizing online judicial video processes, which are attended daily by about 250 people from a special contingent.
In addition, the regime and security department ensures that internal order is not violated. For example, a serving person assigned to a food block should not leave the same block. He had to work eight hours. They are paid a monthly salary of about 60 thousand rubles for this work.
–Where do they spend their months?"
"It's up to them. Some people pay fines, alimony, others collect them, send them to relatives, or buy them in stores.
–Is there such a possibility in the isolation unit? How is the order of operation of stores?
- One of the subsequent benefits of humanization of punishment, digital technology is these online stores. While we have three online stores operating from the outside, we have one online store inside. In order to create a competitive environment in this area, a second store will be opened from the inside. If we talk about the question of how they can trade through this online store, then the ways and order of it are as follows. Convicted and accused persons enter the phone number of a relative through the terminal. Then his relative receives an SMS message. "Your child is asking you for this amount of money." If you give him five thousand, ten thousand Tenge, the firm will deliver the child what he needs, such as drinks, socks, cigarettes, Tursi, toilet paper. We will make sure that these stores are not too expensive. They work in accordance with the established procedure.
–How is the procedure for receiving a greeting card implemented in your country?
–In accordance with the principle of "listening government" of the president, the minister instructed to approach the population, ensure transparency and accessibility. People's trust is always important to us. Currently, we are doing a lot of work in this direction. About 200-300 people bring greetings and greetings to our institution every day. Previously, their reception hours were from 9 am to 13.00 pm. Recently, due to the pandemic situation in the country, we have changed this schedule in order to reduce the number of people and reduce the number of queues. Now Hello Saukat is accepted from 9 am to 18.00 pm. This, on the one hand, is good for the public, and it has caused some problems for our employees. Because they used to receive greetings before noon, and then distribute them after noon. Now they have until six o'clock in the evening. He distributes the parcels he receives at six to eight, up to nine. The two groups work together without a lunch break. All these are decisions that have been made because they consider it easier for the people. Our institution is located on the outskirts of the city. For those who live in the center or in another direction of the city, it is difficult to get to this place. Therefore, despite the small number of employees, we carry out our activities conscientiously.
