Issuance of an act of state control and valuation when exporting precious metals (except for products made from them), scrap and waste precious metals from the territory of the Republic of Kazakhstan to countries outside the Eurasian Economic Union, the export of which is carried out on the basis of a license (without a license)
(hereinafter - the Act of State Control)
State control of precious metals and raw materials containing precious metals is an administrative procedure that is carried out for the implementation of state control of precious metals and raw materials containing precious metals.
State control and valuation of precious metals (with the exception of products made from them), scrap and waste of precious metals exported from the territory of the Republic of Kazakhstan to countries outside the Eurasian Economic Union, the export of which is carried out on the basis of a license (without a license) is carried out on the basis of an Act of state Control issued by the Committee for Industrial Development and Industrial Safety of the Ministry of Investment and Development of the Republic of Kazakhstan.
The rules for issuing the Act of State Control were approved by the Decree of the Government of the Republic of Kazakhstan dated July 22, 2016 No. 422 "On approval of the Rules for importation into the territory of the Republic of Kazakhstan from countries outside the Eurasian Economic Union and export from the territory of the Republic of Kazakhstan to these countries of precious metals and raw materials containing precious metals, and recognition of some decisions of the Government of the Republic of Kazakhstan as invalid".
The procedure for submitting and reviewing an application for an Act of State Control is established by Appendix 4 to the Order of the Minister for Investment and Development of the Republic of Kazakhstan dated April 30, 2015 No. 564 "On approval of standards of public services in the field of mining and metallurgical industry".
Acceptance of the application and issuance of the result of the provision of public services is carried out through the e-government web portal www.egov .kz, www.elicense.kz.
The term of rendering the state service: from the moment of delivery of the package of documents to the portal – 5 (five) working days.
The service provider checks the completeness of the submitted documents within 2 (two) business days from the date of receipt of the documents of the service recipient. If the fact of incompleteness of the submitted documents and (or) expired documents is established, the service provider refuses to accept the application.
The list of documents required for the provision of public services to the service recipient on the portal:
request in the form of an electronic document certified by the service recipient's EDS;
copies of documents in accordance with the decision of the Eurasian Economic Commission:
1) a copy of a foreign trade agreement (contract), an appendix and (or) an addendum to it, and in the absence of a foreign trade agreement (contract) - a copy of another document confirming the intentions of the parties;
2) specification for goods containing precious metals indicating the full range of goods, quantity and weight;
3) calculation of the value of precious metals and precious stones contained in exported goods;
4) a copy of the document on special registration or a copy of the license for the type of activity;
5) a copy of the document(s) confirming the legality of the possession (acquisition) of goods, or a copy of the intermediary agreement;
6) regulatory and technical and (or) technical documentation for exported goods (with the exception of jewelry);
7) a copy of the license or contract (agreement) for the right to use the subsoil or the act of registration of the contract (agreement) for the right to use the subsoil (for mining entities).
a copy of the document confirming the refusal of the National Bank of the Republic of Kazakhstan to exercise the priority right to purchase refined gold to replenish assets in precious metals (in case of export of refined gold);
a copy of the document issued by an accredited testing laboratory on the content of precious metals and related recoverable metals, which should contain information on the specific content of all precious metals in raw materials containing precious metals;
a copy of the conclusion for export (in case of export of goods);
a copy of the conclusion for processing (in case of export of goods for processing).
