Import into the customs territory of the Eurasian Economic Union and export from the customs territory of the Eurasian Economic Union of precious metals and raw materials containing precious metals for processing purposes is carried out on the basis of an Opinion issued by the Committee for Industrial Development and Industrial Safety of the Ministry of Investment and Development of the Republic of Kazakhstan.
The rules for issuing the Conclusion were approved by the Decree of the Government of the Republic of Kazakhstan dated July 22, 2016 No. 422 "On approval of the Rules for importation into the territory of the Republic of Kazakhstan from countries outside the Eurasian Economic Union and export from the territory of the Republic of Kazakhstan to these countries of precious metals and raw materials containing precious metals, and recognition of some decisions of the Government of the Republic of Kazakhstan as invalid".
The procedure for submitting and reviewing an application for an Opinion is established by Appendix 3 to the Order of the Minister for Investment and Development of the Republic of Kazakhstan dated April 30, 2015 No. 564 "On approval of standards of state services in the field of mining and metallurgical industry".
Acceptance of the application and issuance of the result of the provision of public services is carried out through the e-government web portal www.egov .kz, www.elicense.kz.
The term of rendering the state service: from the moment of delivery of the package of documents to the portal – 7 (seven) working days.
The service provider checks the completeness of the submitted documents within 2 (two) business days from the date of receipt of the documents of the service recipient. If the fact of incompleteness of the submitted documents and (or) expired documents is established, the service provider refuses to accept the application.
The list of documents required for the provision of public services to the service recipient on the portal:
1) request in the form of an electronic document certified by the service recipient's EDS;
2) for subjects of extraction of raw materials containing precious metals – a copy of the contract for subsoil use rights. At the same time, it is not required to submit a contract for subsoil use rights, if a copy of such a document was submitted earlier, except in cases when changes and additions were made to such a document;
3) for other organizations that have the right, in accordance with the legislation of the Republic of Kazakhstan, to carry out operations with raw materials containing precious metals – a copy of the document confirming the ownership of exported raw materials;
4) a copy of the foreign trade agreement (contract), the annex and/or supplement to it in the national and/or Russian languages, and in the absence of a foreign trade agreement –contract) - a copy of another document confirming the intentions of the parties. If there is no contract (contract, agreement) in the state and/or Russian languages, then a copy of the contract (contract, agreement) is accompanied by a sealed and certified translation by the applicant (indicating the position and date, signature and seal of the applicant);
5) a copy of a document issued by an accredited testing laboratory on the content of precious metals and related recoverable metals, which must contain information on the specific content of all precious metals in raw materials containing precious metals;
6) refusal of processing and (or) refining of goods from all subjects of precious metals production or confirmation by the authorized body of the existence of such a refusal received in the manner approved by the authorized body.
