HOW IS BORDER TRANSPORT LEGALIZED FROM ABROAD?
With the participation of the akim of the district Tolegen Toregaliev, a meeting was held with car owners to explain the procedure for the legalization of foreign cars imported into the territory of the Syrymsky district. The meeting was attended by First deputy of the district police department Zhanbolat Murzashev, head of the administrative police department of the district police department Bakytzhan Kazakhstanov.
At the meeting, Bakytzhan Kazakhstanov made a report on the legalization of foreign cars. On September 1, 2022, the Head of State Kassym-Jomart Tokayev made a report "Adil memlekettik. One nation. In the Message "prosperous society", the government was tasked to legalize foreign cars imported into the Republic of Kazakhstan before September 1 and not passed state registration in accordance with the legislation of the Republic of Kazakhstan, with the payment of a one-time fee of 200 thousand tenge for initial registration. In order to implement this instruction, amendments to the Code of the Republic of Kazakhstan "On Taxes and other mandatory payments to the Budget" have been developed and are currently adopted by the Parliament, providing for the payment of a fee of 200 thousand tenge for the initial registration of cars subject to legalization. Amendments have been made to the Environmental Code regarding the abolition of recycling fees for legalized cars at the same time. Currently, the relevant amendments are under consideration in the Senate of the Parliament.
In addition, the Ministry of Internal Affairs has developed a draft government decree defining the procedure for the legalization of vehicles imported into the Republic of Kazakhstan before September 1, 2022 and have not passed state registration in accordance with the legislation of the Republic of Kazakhstan. This project was posted on the official website of the Ministry of Internal Affairs for public discussion on November 29 of this year. During the public discussion, all proposals received from the population will be considered. According to the draft, the legalization of foreign cars will last from January 1, 2023 to July 1, 2023.
-An application for legalization can be submitted through the "e-government portal" or directly to the Special Center. All necessary payments will be made after the decision of the authorized body (Ministry of Internal Affairs) on the legalization of motor vehicles. Cars subject to legalization are not subject to registration on the search database, write-off at the place of previous registration, undergo full customs clearance. For vehicles registered in the Republic of Belarus, the Russian Federation and Armenia, customs clearance is not required. Cars from the Republic of Armenia that have previously been registered in the Republic of Kazakhstan with the receipt of state numbers with a yellow background are also subject to legalization with payment of an initial registration fee of 200 thousand tenge, for these cars additional customs clearance is not required.
Cars imported from the Kyrgyz Republic, at the request of the owners, will be registered before January 1, 2025 without the right of alienation. After the specified period, a restriction on their alienation will be automatically levied, or in case of additional payment of customs duties at the rates of the EAEU, these cars will be registered for the right of alienation without restrictions. Cars imported from non-EAEU countries must pass customs clearance. There are no restrictive requirements for the year of manufacture and compliance with the environmental class for legalized cars. The problem of legalizing legalized legal cars with legal documents is at the stage of solution, - says B. Kazakhstanov.
"I got a car from Russia 3-4 years ago. The contract of sale is concluded on handwritten paper. There is no print. The passport of the vehicle (PTS), the certificate of registration of the vehicle (STS) are on hand. Now my car is abroad. And the owner of the car does not live at the same address. What can be done in such a situation?" says Kemel Yessultanov. The police responded to him that the car should first be taken off the register from abroad. Well, if the answer comes to the demand that there are no cars registered abroad, then you do not need to go to the state. Without criminal signs, cars continue to be registered. "Well, what happens if the car is registered in another country, if there is no purchase and sale agreement, if there is no unpaid tax? What should I do if I purchased a car in Armenia from a citizen of Kazakhstan registered in temporary citizenship?"citizens must also first determine whether the car is registered in the country of import from the PSC. Previously, there were cases when Kazakh citizens entered Armenia for temporary registration for three days, were removed from the register after receiving transport and returned to the country. More than 500-600 cars are registered per person in Armenia, all of them have been sold to Kazakhstan. To write off all this, you need to pay a tax on everyone. In Kazakhstan, there are cars from hand to hand, in this case, who submits documents for legalization, the car is issued in the name of this citizen. To remove a car from the register, it is necessary to provide a way for all car owners to travel abroad without driving. Kairbek Amangaliyev also proposed to register cars imported from non-EU countries without a tax on self-assembly. This issue was also brought to the Ministry. Adilkhan Almurzin expressed the wrong opinion that the cost of registration should be 200 thousand tenge for both "Zhiguli" and "jeep" worth 200 thousand tenge. This request is brought to the top.
No insurance policy will be issued for foreign cars. The owner of the car whose insurance period expired in December is no longer insured. "If the car is wanted abroad, can foreigners come and pick it up again?"- citizens asked a question. The answer to this question was that "they can't take the car back."
It was noted that if the owners of vehicles with a temporary yellow number do not want to pay 200 thousand tenge, they are subject to registration, since this number is temporary, and movement on vehicles with a yellow number is prohibited.
If there are about three hundred foreign cars in the area, then finding owners to write off all this is not an easy task. The akim of the district noted that this issue should be transferred to a higher one, as it is not recommended. The presence of the car in the report https://pay.e-community.am/ru/tax-search/vehicles you can check on the website.
A citizen who wants to change the role of the car to the left must receive a special replacement certificate. Then it goes and registers.
First Deputy head of the district police department Zhanbolat Murzashev said that the proposals of the owners of foreign cars across the country are being heard and collected, and the Ministry of Internal Affairs will send proposals to parliament.
Akim of the district Tolegen Toregaliev: "a car has arrived in the country. The people live and lead in need. Now the problem is that you need to legalize the car somehow. A lot of cars from abroad, including the region, the Republic, and not a couple of cars. Having drawn conclusions from our proposals, the Ministry of Internal Affairs will present proposals from Russia, Armenia, and Belarus. The issues raised are not resolved within the framework of Kazakhstan alone. Taking into account the legitimacy of our country and the state of arrival of transport. Please make changes to the registration of cars that arrived before September 1 and propose to legalize those who entered before January 1," he said.
