In accordance with subparagraph 4) of paragraph 1 of the Decree of the President of the Republic of Kazakhstan dated March 16, 2020 "On measures to ensure socio-economic stability", part 2 of paragraph 2 of article 12-1 of the Law of the Republic of Kazakhstan from February 8, 2003 "About state of emergency", paragraph 11 of the minutes of the meeting of the State Commission on ensuring the regime of a state of emergency under the President of the Republic of Kazakhstan from March 18, 2020 No. 3, order of the President of the Republic of Kazakhstan, given at the meeting of the State Commission for ensuring the state of emergency under the President of the Republic of Kazakhstan dated March 23, 2020, I ORDER:
- Approve the attached Rules for the provision of certain public services in the social and labor sphere and the procedure for providing food and household supplies to certain categories of the population during the state of emergency.
- the Department of analysis and development of public services of the Ministry of labor and social protection of the population of the Republic of Kazakhstan shall provide:
1) state registration of this order in the Ministry of justice of the Republic of Kazakhstan;
2) placement of this order on the official Internet resource of the Ministry of labor and social protection of the population of the Republic of Kazakhstan;
3) finishing of this order to the regional cities of Nur-Sultan, Almaty and Shymkent of offices of employment and social programs, territorial divisions of Committee of labor, social protection and migration of the Ministry of labour and social protection of population of the Republic of Kazakhstan noncommercial joint-stock company "Public Corporation "Government for citizens", joint-stock company "Center of development of labor resources" and joint-stock company "the State social insurance Fund".
- control over the execution of this order shall be assigned to the Vice-Minister of labor and social protection of the population of the Republic of Kazakhstan N. N.

Rules for the provision of certain public services in the social and labor sphere and the procedure for providing food and household supplies to certain categories of the population during the state of emergency

Chapter 1. Procedure for providing public services during a state of emergency
- For the period of the emergency the provision of the following public services (hereinafter – services) on the basis of the electronic application submitted via the "Electronic treatment" (hereinafter – the Service) on the web portal of "Electronic government" (further – the Portal), completed in accordance with the Annex to this Regulation provide certain public services in social and labor sphere for the period of emergency (hereinafter – the Rules), as well as through the Internet resource:
1) assignment of pension payments by age;
2) appointment of the state basic pension payment;
3) appointment of state special allowances;
4) assignment of social benefits for cases of loss of income in connection with the adoption of a newborn child (children) and loss of income in connection with the care of a child upon reaching the age of one year;
5) assignment of social benefits in cases of loss of income due to pregnancy and childbirth;
6) assignment of social assistance in the form of monthly payments to citizens of the Republic of Kazakhstan after the end of the period of capitalization of payments for compensation for damage caused to the life and health of employees by legal entities liquidated as a result of bankruptcy;
7) registration of documents for disabled people to provide them with prosthetic and orthopedic care;
8) providing people with disabilities with Surdo-typhlo-technical and obligatory hygienic means;
9) registration of documents for the disabled to provide them with the services of an individual assistant for the disabled of the first group who have difficulty in movement, and a sign language specialist for the hearing impaired;
10) provision of wheelchairs for disabled people;
11) provision of health resort treatment for
disabled
people 12) registration of documents for the provision of special social services in the conditions of home care;
13) registration of documents for the provision of special social services in medical and social institutions (organizations);
14) assignment or extension of oralman status;
15) purpose of state targeted social assistance;
16) appointment of a special state allowance;
17) assignment of state allowances to large families;
18) assignment of benefits for the care of a disabled person of the first group from childhood;
19) assignment of social assistance to certain categories of citizens in need by decisions of local representative bodies;
20) determination of disability and / or degree of disability and / or determination of necessary social protection measures;
21) issue or extension of a certificate to a foreigner or a stateless person on compliance with the qualification for self-employment;
22) registration of citizens affected by nuclear tests at the Semipalatinsk nuclear test site, payment of one-time state monetary compensation, issuance of certificates;
23) issuing a certificate to a rehabilitated person;
24) training in the basics of entrepreneurship under the "Bastau Business" project";
25) assistance to job seekers and the unemployed
- When applying to receive the above services through the Service, the applicant fills the application in accordance with the relevant standard of the state service (hereinafter – the Standard), and applies electronic files containing scanned versions of the documents referred to in paragraph 9 of the Standard, and is signed by the electronic digital signature (further – EDS).
In this case, the application specified in paragraph 9 of the relevant Standard is attached in the form of an electronic file without the applicant's signature.
- The recipient of the application (destination) indicated in accordance with the Register of public services – the corresponding branch of the non – profit joint – stock company "state Corporation "Government for citizens" (hereinafter-the State Corporation), local Executive body or territorial Department Of the Committee of labor, social protection and migration of the Ministry of labor and social protection of the population of the Republic of Kazakhstan (hereinafter-the Department).
- the application Signed by the service recipient's EDS is sent by the Portal to the electronic document management system of a branch of a State Corporation, local Executive body or Department.
- A branch of the State corporations, local government and the Department within 2 working days sends the electronic application to the relevant district or city branch of the State Department of corporations, Department of employment and social programs Center of employment of the population of the city or district, division of medico-social examination Department (hereinafter – Department ITU) at the place of residence of the service recipient, respectively.
- a Specialist of the district or city Department of a branch of a State Corporation, the Department of employment and social programs, the employment Center and the ITU Department checks the documents for compliance with the Standard of the relevant state service within 2 working days.
- if you have any questions, a specialist of the district or city Department of a branch of a State Corporation, the Department of employment and social programs, the employment Center and the ITU Department contacts the service recipient by phone number or e-mail specified in the electronic application.
- if the received documents meet the Standard of the relevant state service, a specialist of the district or city Department of a branch of the State Corporation, the Department of employment and social programs, the employment Center and the ITU Department forms an electronic layout of the case (the ITU act) in the appropriate information system.
- Consideration of the received electronic layout of cases (ITU act) by service providers is carried out in accordance with the bylaws regulating the procedure for providing public services, taking into account the features provided for in these Rules.
- Notification of the result of rendering a public service (refusal to provide it) is sent via sms to the mobile subscriber number of the service recipient and to the personal account of the service recipient on the Portal (if technically possible), or is sent as a response to an application received through the Service.
If a notification about the result of providing a service (refusal to provide it) is sent to the service recipient's personal account on the Portal or to a mobile subscriber device, the response to the service recipient via the electronic document management system is not provided to exclude the repeated notification process.
- Appeal against the result of rendering a public service by the service recipient is regulated by a subordinate regulatory legal act that defines the procedure for rendering the relevant public service.
Chapter 2. Features of the procedure for providing certain public services
Paragraph 1. Features of the procedure for rendering the state service "Assignment of state targeted social assistance" during the state of emergency
- If the beneficiary is a recipient of state targeted social assistance (hereinafter referred to as targeted social assistance), in order to exclude direct contact, targeted social assistance is automatically extended for a new period to the recipient without an application.
- In the case of an initial request for targeted social assistance to exclude direct contact, the precinct Commission conducts a survey of the service recipient and (or) the family by means of communication devices.
- the Result of rendering the state service is sent to the service recipient in electronic form by means of communication devices.
- Issues of assigning targeted social assistance that are not regulated by paragraphs 12-14 are determined by the Rules for assigning and paying state targeted social assistance and providing a guaranteed social package, approved by order No. 320 of the Minister of health and social development of the Republic of Kazakhstan dated may 5, 2015 (registered in the Register of state registration of regulatory legal acts for No. 11426).
Paragraph 2. Specifics of the procedure for rendering the state service "determination of disability and / or degree of disability and / or determination of necessary social protection measures" during the state of emergency
- Disability and/or degree of disability and/or determination of necessary measures of social protection departments conducted by the ITU in absentia in accordance with the Rules of carrying out medico-social expertise, approved by order of Minister of health and social development of the Republic of Kazakhstan from January 30, 2015 № 44 "On approval of Rules of carrying out medico-social examination" (it is registered in the state Register of regulatory legal acts for No. 10589), for a period of no more than one year with a check-up of the examined person within six months from the date of establishing the disability.
- Persons, the period of re-examination which occurred no more than a month before the imposition of emergency and during state of emergency, dates of disability, degree of loss of work capacity, degree of incapacity and the individual program of rehabilitation of disabled persons, shall be extended automatically for the period of the emergency.
Paragraph 3. Specifics of the procedure for providing the state service "assistance to job seekers and the unemployed" during the state of emergency
- Registration as a job seeker is carried out at the place of residence through the e-government web portal on the basis of documents:
1) confirming employment (if available);
2) about education, qualification, availability of special knowledge or professional training (if any).
- The decision to register job seekers is made by the employment Center.
- the employment Center of the population within one working day from the date of registration of the person looking for work, assists him in the selection of a suitable job.
- If the employment Center has not selected a suitable job for the applicant within the period specified in paragraph 20 of these Rules, an employee of the employment Center within one working day after the expiration of the specified period forms a draft decision on registration of a job seeker as an unemployed person with the attachment of the documents of the job seeker, which is signed by the Director of the employment Center or an authorized person by means of an EDS, and sends it to the local employment Agency through the automated information system "labor Market "(hereinafter – AIS"labor Market").
- the Local employment Agency checks the accuracy of the information received through the AIS "labor Market" in the information systems of state bodies and (or) organizations.
The first head of the local employment Agency or a person authorized by it signs the decision to register a job seeker as an unemployed person by means of an electronic digital signature in the AIS "labor Market" within one working day.
- Questions assist job-seekers and unemployed persons not covered by paragraphs 18-22 are defined by the Rules of registration of job seekers, the unemployed and implementation of labour mediation provided by the employment centres, approved by order of Minister of labor and social protection of population of the Republic of Kazakhstan dated June 19, 2018 № 259 "On approval of Rules of registration of job seekers, the unemployed and the implementation of labor intermediation, provided by employment centers of the population" (registered in the Register of state registration of normative legal acts for No. 17199).
Paragraph 4. Specifics of the procedure for making payments of state social benefits for disability and social payments in case of disability during a state of emergency
- Persons referred to in paragraph 17 of these Rules, are recipients of state social benefits for disability and (or) social benefits in case of disability, payments for the period of emergency are carried out on the previous group of disability and (or) extent of loss of total capacity to labor by the month of expiration of the emergency rule, including.
Chapter 3. Procedure for providing food and household items to certain categories of the population
- Food and household supplies are provided for the period of emergency:
children aged six to eighteen years, from among the recipients of targeted social assistance;
children with disabilities under the age of sixteen, with the exception of persons with disabilities permanently residing in medical and social institutions;
persons with disabilities of the first, second and third groups of all ages, with the exception of persons with disabilities permanently residing in medical and social institutions;
raising a disabled child;
unemployed persons registered with the local employment authority.
- the List of persons specified in paragraph 25 of these Rules is formed by local Executive bodies on the basis of data from information systems of state bodies and organizations.
- the Composition of the food and household set is determined by local Executive bodies based on economic opportunities, but not less than two monthly calculation indicators.
- Local Executive bodies conclude public procurement contracts with suppliers defined by the decree of the Government of the Republic of Kazakhstan dated January 31, 2020 No. 22.
- Local Executive bodies may provide food and household items by transferring funds to the accounts of the persons specified in paragraph 25 of these Rules for the purchase of food and household items.
- Suppliers deliver to the addressee in accordance with the public procurement agreement.
