Regulations on the structural division of a state body
Chapter 1. General provisions
1.the Department of Public Procurement Procedures for Works is a structural subdivision of the state institution "Department of public procurement of the West Kazakhstan region".
2.the structural division is guided in its activities by the Constitution, laws of the Republic of Kazakhstan, acts of the president and Government of the Republic of Kazakhstan, other normative legal acts, as well as this regulation.
3.the structure and staff size of a structural division is approved by an authorized official of the state body within the limit of the staff size in accordance with the procedure established by the legislation of the Republic of Kazakhstan.
Chapter 2. Goals, rights and obligations of a structural division of a state body
4. Purpose: implementation of the state policy in the field of Public Procurement.
5. rights and obligations:
1) within the limits of its competence, submit proposals for solving problems in the field of public procurement in the territory of the West Kazakhstan region, the main directions of development, for consideration by the head of the Department;
2) within the limits of its competence, in agreement with state bodies, officials, organizations and citizens, in accordance with the established procedure, request and receive information on issues related to the performance of the tasks assigned to the Department;
3) represents the interests of the state institution "Department of public procurement of the West Kazakhstan region" in state bodies, courts within its competence;
4) Exercise other rights and obligations stipulated by the legislation of the Republic of Kazakhstan.
6. functions:
1) organizes and conducts public procurement of works in accordance with the current legislation;
2) conducts public procurement on the basis of the annual public procurement plan developed and approved by the customer in accordance with the methods provided for by the current legislation;
3) develops and submits for approval tender documentation (auction documentation) in Kazakh and Russian languages on the basis of an order submitted by the customer containing documents established by the rules for conducting public procurement;
4) places an announcement of Public Procurement on the web portal of Public Procurement;
5) sends requests and comments to the customer from persons who have received the tender documentation (auction documentation) and (or) the technical specification of the tender documentation (auction documentation), automatically registered on the web portal of Public Procurement;
6) if necessary, make changes and / or additions to the tender documentation (auction documentation) ;
7) in cases stipulated by the legislation, make security of the application for participation in electronic public procurement by means of a tender or auction in the revenue of the relevant budget or return it to the potential supplier;
8) determines the composition of the Competition Commission (auction commission) and submits it for approval;
9) sends invitations to potential suppliers who have submitted technical proposals at the first stage to participate in the second stage of public procurement by means of a tender using two-stage procedures;
10) determines the winner of public procurement by means of a tender (auction) ;
11) carry out public procurement of certain types of works in accordance with the procedure established by law;
12) apply to the court with a statement of claim for recognition of a potential supplier or supplier as an unfair participant in public procurement in cases stipulated by the legislation;
13) performing other tasks within the limits of their competence.
Chapter 3. Organization of activities of a structural division of a state body
7.a structural division has the rights and obligations necessary for the implementation of its tasks in accordance with legislative acts of the Republic of Kazakhstan, acts of the president and other normative legal acts of the Republic of Kazakhstan.
8.a structural division of a state body is headed by a head who is appointed and dismissed in accordance with the procedure established by the legislation of the Republic of Kazakhstan.
9.the head of a structural division of a state body exercises general management of the activities of the structural division, is personally responsible for the performance of the tasks assigned to it and the exercise of his / her powers.
10.the head of the structural division submits proposals to the management of the state body on the structure and staffing of the structural division.
11.documents sent to other structural divisions on behalf of the structural division of the state body on issues falling within the competence of the structural division are signed by the head of the structural division, and in case of his absence – by the person replacing him.
