On December 20, 2019, a meeting of the Supreme Eurasian Economic Council was held, at which the heads of the member states of the Eurasian Economic Union (EAEU) signed an Agreement on pension provision for workers of the member States of the Eurasian Economic Union, according to which each EAEU member state guarantees citizens of other EAEU member states the amount of pension rights equal to the amount of rights provided to its citizens on similar terms.
Since 01.01.2021, after the ratification of the Agreement by all the EAEU states, their citizens working in other EAEU countries form, preserve and exercise their pension rights on an equal basis with the citizens of the country in which they are employed. Each EAEU member state now pays a pension according to its legislation for the length of service acquired by workers on its territory after 01.01.2021. If the length of service of an employee acquired in the territory of one member State is not sufficient for the right to a pension (with the exception of a funded pension), then the length of service acquired in other EAEU countries, including before the entry into force of the Agreement, is taken into account, except in cases when such length of service coincides in time. It is worth noting that citizens of the EAEU countries must formalize employment relations with employers in the countries of employment, that is, they must conclude labor or civil law contracts in a timely manner.
Implementation of the Agreement in Kazakhstan
In Kazakhstan, the Agreement applies to legal relations on the payment of pension contributions to the UAPF and pension payments from the UAPF under the legislation of the Republic of Kazakhstan upon reaching retirement age or upon the establishment of disability of 1,2 groups indefinitely.
For example, if a citizen of Kazakhstan acquires work experience (for example, 3-5 years) in the territory of the EAEU member state after the entry into force of the Agreement, if the right to a pension arises under the terms of the pension legislation of the country of employment (reaching retirement age, having a certain length of service), the country in which the migrant worked will assign a pension for the length of service worked in this country. At the same time, a citizen of Kazakhstan will have the right to submit an application with documents for the appointment and payment of a pension to the competent authority of the EAEU country or to the UAPF, as the competent authority in the Republic of Kazakhstan.
The list of documents for the appointment and payment of a worker's pension is regulated by the national legislation of each EAEU member State.
Competent authorities
The competent authorities in the Republic of Kazakhstan for confirming the work experience of workers of the EAEU member States are JSC "UAPF", the Committee for Labor and Social Protection of the Population of the Ministry of Labor and Social Protection of the Population of the Republic of Kazakhstan and their territorial divisions.
The UAPF provides information on work experience since January 1, 1998 on the basis of data on the payment of mandatory pension contributions available in the information system.

Agreement in numbers
As part of the implementation of the Agreement in the Republic of Kazakhstan in the period from 01.01.2021 to 01.02.2024.:
82,845 workers-citizens of the EAEU member states who carry out labor activities on the territory of Kazakhstan on the basis of employment and civil law contracts concluded with employers, pension contributions to the UAPF were transferred and individual pension accounts were opened in an undeclared manner;
The UAPF accepted and executed applications for the appointment of pension payments from 94 citizens of the EAEU member states, including:
- Pension payments have been assigned to 91 workers in connection with reaching retirement age according to the legislation of Kazakhstan;
- 3 heirs have been assigned pension payments in connection with the death of two workers;
4 citizens of Kazakhstan who carried out work activities in the territory of the Kyrgyz Republic and the Russian Federation on the basis of an employment contract and transferred insurance contributions to their pension system, the competent authorities of these countries have been assigned lifetime age pensions.

The UAPF was established on August 22, 2013 on the basis of JSC NPF GNPF. The founder and shareholder of the UAPF is the Government of the Republic of Kazakhstan represented by the State Property and Privatization Committee of the Ministry of Finance of the Republic of Kazakhstan. The trust management of pension assets of the UAPF is carried out by the National Bank of the Republic of Kazakhstan. Since January 1, 2016, the functions of developing proposals to improve the efficiency of pension asset management have been transferred to the National Fund Management Council.
