ASSISTANT TO THE PRESIDENT T. DUISSENOVA SPOKE ABOUT NEW OPPORTUNITIES TO IMPROVE THE QUALITY OF WORK WITH APPLICANTS

Assistant to the President of the Republic of Kazakhstan-Head of the Department for Monitoring the Consideration of Appeals of the AP of the Republic of Kazakhstan Tamara Duissenova visited WKO on a working trip.
From the first of July of this year, the new Administrative Procedural Code of the Republic of Kazakhstan (APPC), signed by the President of the country on June 29, 2020, comes into force. The new Code is the basic normative document of the Concept of the "Hearing State", voiced by the Head of State in the Address to the people of Kazakhstan dated September 2, 2019. The APPC assumes a radical change in the paradigm of the work of state agencies with applicants.
During the meetings of the Assistant to the President with the assets of the region, akims of districts and cities, rural districts, T. Duissenova, explained the features of the work of state bodies in the new conditions and new opportunities to improve the quality of work with applicants.
During the working trip to the West Kazakhstan region, the Assistant to the President met with the governor of the region Gali Iskaliyev and the mayors of districts and heads of territorial and local state bodies, with the mayors of rural districts, heads of structural divisions of Uralsk. There was also a meeting with NGOs, youth public associations, mothers with many children, veterans, and media representatives. Tamara Duissenova also got acquainted with the work of the information system "e-Otinish" in the city PSC and in the Baiterek district, where a meeting with the akims of rural districts and the public was also held.
The group also includes representatives of the state bodies responsible for the project implementation – the Ministries of Digital Development, Innovation and Aerospace Industry, Justice, the Prosecutor General's Office, etc.
So, according to the new APPC, the applicant gets the opportunity to track the progress of consideration of his application by state bodies through the unified information system "e-Otinish", the right to present evidence and participate in their research, including giving explanations, submitting the necessary documents. The applicant will have the right to appeal the response to a higher instance, followed by filing a claim in the administrative court against the state body that made the decision.
Also, the claims of citizens and businesses will be considered by special administrative courts on the principle of"presumption of guilt of the state body". That is, not the applicant, but the state agency will prove to the court the validity of the decision made or the response submitted. Unsubscribing and red tape will become the subject of responsibility not only of the executive officer, but also of the entire state body. The court will help applicants to write their claims correctly in order to eliminate the practice of returning claims on formal grounds. The judge will become "active" and "speaking", will help the plaintiff, defend his interests.
The establishment of administrative justice is in line with the best practices of the OECD countries and has already successfully established itself in such countries as Latvia, Georgia, Moldova, Azerbaijan, etc.
In accordance with the new approaches, the infrastructure of the system for reviewing citizens ' appeals is also changing.
In accordance with the instructions of the Head of State, the Prosecutor General's Office of the Republic of Kazakhstan and the Ministry of Digital Development, Innovation and Aerospace Industry of the Republic of Kazakhstan have developed and are implementing the unified information system "e-Otinish".
"e-Otinish" is a single database where the entire history of the consideration of appeals is stored, accessible to all state and judicial authorities, as well as to applicants.
From July 1 of this year, a phased transition to "e–Otinish" will be carried out and citizens ' appeals to state bodies will be received through a single information system.
In turn, the applicant will be able to track the progress of consideration of the application, the period of consideration of which is reduced from 30 to 15 days.
To date, 100% of central state and local executive bodies have already been connected to the information system, and pilot testing has begun on a national scale.
