Illegal power outages

In the West Kazakhstan region, cases of non-compliance by energy supplying and energy transmission organizations with the Rules for the use of electrical energy on disconnecting a consumer for non-payment of bills for used electrical energy without a corresponding notification have become more frequent.

In order to prevent negative social consequences and otherwise interpret the requirements of the current Rules, I would like to clarify the following:

According to paragraph 7 of the Standard Electricity Supply Agreement approved by order of the Minister of Energy of the Republic of Kazakhstan dated October 23, 2017 No. 356 (hereinafter referred to as the agreement): Consumers who use electrical energy for household needs pay no later than the 25th day of the month following the billing period. In the absence of payment after the 25th day of the month, the power supplying or power transmission (power generating) organization stops supplying electricity in whole or in part.

It is important to know that in this case, the consumer must be notified in writing prior to the expected shutdown date at least 30 (thirty) calendar days in advance. Also, the consumer must be notified before the power outage.

At the same time, we note that the notification of the planned shutdown should be sent to the consumer after the occurrence of the event specified in clause 7 of the contract, i.e. after the end of the period of voluntary payment. In this connection, the notice issued by the energy supplying organization in the payment document (invoice-notice) does not meet the requirements before the occurrence of cases that cause grounds for terminating the supply of electricity to the consumer.

For example, a resident of the WKO must pay for the electricity used in April no later than May 25, in the absence of payment, the power supply or power transmission organization sends a written notification (warning) and has the right to disconnect no earlier than June 25.

In accordance with the legislation of the Republic of Kazakhstan on the electric power industry, the body for state energy supervision and control exercises control over compliance with the requirements of regulatory legal acts. , with the subsequent initiation of an administrative case and bringing the offender to administrative responsibility.
