KAZAKHSTAN'S PARLIAMENT HAS RATIFIED CONVENTIONS ON CRIMES AND CERTAIN OTHER ACTS COMMITTED ON BOARD AIRCRAFT

Today, Members of the Senate of the Parliament of Kazakhstan have ratified the " Convention on crimes and certain other acts committed on Board aircraft (Tokyo, 1963) and the Protocol amending the Convention on crimes and certain other acts committed on Board aircraft (Montreal, 2014) and the "Convention for the suppression of unlawful seizure of aircraft (the Hague, 1970) and the Protocol supplementing the Convention for the suppression of unlawful seizure of aircraft (Beijing, 2010).

The Tokyo Convention and the Montreal Protocol are aimed at curbing undisciplined behavior and disorderly conduct on Board an aircraft.

"States parties have the right to exercise their jurisdiction over crimes committed on Board an aircraft, if they are the state of registration or as the state of landing of the aircraft in question. The Convention and the Protocol define and expand the powers of the aircraft commander and crew members in terms of applying restrictive measures in flight against undisciplined passengers, " Minister for investment and development of Kazakhstan Zhenis kassymbek said in his speech to the senators.

The Hague Convention and the Beijing Protocol, which supplements it, are aimed at determining criminal liability for crimes related to the illegal seizure of aircraft and establishing its jurisdiction over such crimes.

These international treaties provide for liability in relation to partners in crime. The Beijing Protocol expands the list of acts of illegal seizure of aircraft. In particular, control over an aircraft by interfering with air navigation systems and the use of cyber attacks were additionally introduced. It is also considered a crime if a person threatens to commit such a crime.

The current legislation of the Republic of Kazakhstan provides for the norms of responsibility for these acts.

The implementation of these international agreements will allow us to comply with the requirements of the UN Security Council in terms of countering terrorism, as well as to respond properly to threats to the safety of civil aviation.
