1. The Department for Control Over the Consideration of Applications (hereinafter referred to as the Department) of the Office of the Akim of the Atyrau region was created to control (subtask 1, paragraph 3) the consideration and analysis of applications from individuals and legal entities living in the territory of the Atyrau region.
2. The Department in its activities is guided by the Constitution, the laws of the Republic of Kazakhstan "On the procedure for considering applications of individuals and legal entities", "On local government and self-government in the Republic of Kazakhstan", other laws of the Republic of Kazakhstan, acts of the President and the Government of the Republic of Kazakhstan, other regulatory legal acts, as well as decisions of the akim of the Atyrau region and these Regulations.
3. The Department in the implementation of the Regulation on the communal state institution "Office of the Akim of the Atyrau region" performs the tasks and functions specified in the relevant sections of this Regulation.
4. Tasks and functions of the Department for control over the consideration of applications of the Office of the Akim of Atyrau region
1. The tasks and functions of the Department for Control Over the Consideration of Applications are:
task 1: organizing the reception and consideration of applications from individuals and legal entities;
subtask 1: receiving applications from individuals and legal entities;
functions:
1) preliminary consideration, analysis, acceptance and registration of applications from individuals and legal entities entering:
on paper, including through Kazpost JSC, as well as on purpose to the Department;
in electronic format through the website of the akimat of the Atyrau region and the portal of "electronic government" of the Republic of Kazakhstan "egov.kz";
2) determination of the nature of issues, distribution of applications from individuals and legal entities and their direction to structural units of the Office of the Akim of Atyrau region, other state and local executive bodies for consideration and submission of an answer, or formation of a position on problems raised in applications of individuals and legal entities, except for applications, the procedure for consideration of which is established by the legislation of the Republic of Kazakhstan on administrative offenses, criminal procedure, civil procedure legislation of the Republic of Kazakhstan;
3) control over the consideration of applications of individuals and legal entities sent to state and local executive bodies, including the district/village level;
4) within the competence of the Department, analysis of the quality of responses of state bodies and local executive bodies and the measures taken by them on the applications of individuals and legal entities, taken under the control of the akim;
within the competence of the Department, direction for revision of the answers of state and local executive bodies in case of their poor quality;
5) organization of accounting and maintenance of current office work on requests from individuals and legal entities within the competence of the Department;
subtask 2: organization of reception of citizens and representatives of legal entities;
functions:
1) organization and conduct of personal reception of individuals and legal entities by the akim of the region, deputy akim of the region, officials of the akim's apparatus, heads of structural divisions of the Office of the Akim of the region and control over the consideration of applications and instructions given during personal reception of individuals and legal entities;
2) ensuring the participation of the supervising deputy akim of the region, the deputy head of the structural divisions of the Office of the Akim of the region during personal reception of individuals and legal entities;
3) provision of consulting assistance to individuals and legal entities within the competence of the Department;
4) organization of personal reception of individuals and legal entities in the Office of the Akim or in another inhabited locality of the region, including in the format of videoconference with the assistant to the President of the Republic of Kazakhstan - the head of the Department for Control Over the Consideration of Applications of the Presidential Administration;
5) organization of regular field receptions of individuals and legal entities by the akim of the region, deputy akim of the region and heads of structural divisions of the Office of the Akim of the region, including in the format of video conferencing;
6) monitoring of the work on the reception and consideration of applications from individuals and legal entities by local executive bodies of the regional level;
7) control over the organization and conduct of personal reception of individuals and representatives of legal entities by the leadership of local executive bodies of the regional level.
task 2: analysis of incoming requests, identification of systemic problems and development of recommendations for their solution;
functions:
1) content analysis of applications and drawing up information on systemic issues raised by applicants;
2) monitoring problematic issues in the context of the region, forming a map of problematic issues;
3) development, together with the structural divisions of the Office of the Akim, other authorized state bodies of proposals for:
development and implementation of programs aimed at improving the quality of life of the region's population;
improvement of legislation;
other topical issues raised in addresses of individuals and legal entities;
4) development of proposals for further improvement of legislation and law enforcement practice for the consideration of applications from individuals and legal entities;
5) participation in the development of regulatory and methodological documents to improve the procedure for considering applications from individuals and legal entities, as well as documentation and control over the execution of instructions for applications;
6) preparation of draft reports and analytical notes of the regional akim, the head of the regional Office of the Akim in the course of implementing the instructions of the Head of State, the leadership of the Presidential Administration and the Assistant to the President-Head of the Department for Control over the Consideration of Applications of the Presidential Administration in terms of considering applications once every six months;
task 3: organizing interaction with government bodies and civil society;
functions:
1) within the framework of its competence, the development of methodological recommendations for providing advice to individuals and legal entities, receiving and considering applications from individuals and legal entities based on current systemic problems and best practices;
2) within the framework of its competence, the provision of organizational, methodological and informational assistance to local executive bodies on accounting, registration, as well as consideration of applications from individuals and legal entities;
3) within the framework of its competence, the organization initiates the creation of special working groups with the participation of interested authorized state bodies, representatives of civil society and expert communities to develop decisions on significant issues that cause increased public resonance;
4) interaction with responsible structural divisions of the local executive body, other authorized state bodies and the Department for Control Over the Consideration of Applications of the Presidential Administration on the implementation of instructions from the Head of State, Secretary of State, management
The Presidential Administration, given as part of the consideration of applications from individuals and legal entities;
5) ensuring interaction with the regional public receptions of the law enforcement block - the Center for Law Enforcement Services under the Prosecutor's Office of the Atyrau Region, the Situational Center of the Atyrau Court and judicial offices, anti-corruption offices of the Agency of the Republic of Kazakhstan for Combating Corruption "Adaldyk Alany".
6) ensuring interaction with authorized state bodies in the framework of the development and launch of the "E-application" project;
task 4: control over the timely and full implementation by local executive bodies of the instructions of the President, the Secretary of State, the leadership of the Presidential Administration, the Department for Control over the Consideration of Applications of the Presidential Administration, given as part of the consideration of appeals;
functions:
1) exercising control over the activities of structural divisions of the regional Office of the Akim, local executive bodies of the regional level for the consideration of applications for the implementation of instructions from the President, the Secretary of State, the leadership of the Presidential Administration, the Department for Control Over the Consideration of Applications of the Presidential Administration, akim;
2) making proposals to strengthen the performing discipline;
3) on-site inspection of the progress of the execution of instructions from the President, the Secretary of State, the leadership of the Presidential Administration, akim of the region on complex issues of a massive nature;
4) participation, together with the structural subdivisions of the regional Office of the Akim, in inspections on the implementation of acts and orders of the President, the leadership of the Presidential Administration, akim of the region related to requests from individuals and legal entities, executive discipline, making proposals on taking measures to eliminate the identified violations and involve responsibility of officials who committed violations;
5) making proposals on bringing to disciplinary responsibility officials of the regional Office of the Akim, local executive bodies of the regional level on the quality of execution of orders put under the control of the Head of State, the Secretary of State, the leadership of the Presidential Administration and the Department for Control over the Consideration of Applications of the Presidential Administration, organization of monitoring for their execution;
6) participation in reporting collegial events of local executive bodies, akim of the region to discuss the results of consideration of applications from individuals and legal entities;
7) preparation of conclusions based on the results of monitoring the execution of instructions of the Head of State, the leadership of the Presidential Administration, the Department for Control Over the Consideration of Applications of the Presidential Administration, the regional leadership on specific appeals;
task 5: control of compliance with office work requirements in terms of consideration of applications;
functions:
1) within the framework of its competence, checking the state of office work in the Office of the Akim of the region, local executive bodies of the district and rural level in terms of considering applications from individuals and legal entities;
2) control of compliance with the requirements of the legislation on the consideration of applications from individuals and legal entities, instructing newly hired employees of the regional Office of the Akim on the consideration of applications from individuals and legal entities.
