My father died five months ago, when I did not know that I could inherit his retirement savings. Can I apply for them now?
In accordance with Articles 31, 32, 33 of the Law of the Republic of Kazakhstan “On Pension Provision in the Republic of Kazakhstan” (hereinafter referred to as the Law), in the event of the death of a person who has pension savings at the expense of mandatory, mandatory professional and voluntary pension contributions, they are inherited in the manner established the legislation of the Republic of Kazakhstan.
Inheritance of pension savings is carried out by will or by law. According to the Civil Code of the Republic of Kazakhstan, in order to acquire an inheritance, the heir must accept it by filing at the place of opening of the inheritance to a notary or authorized in accordance with the law to issue a certificate of the right to inheritance to an official of an application for acceptance of the inheritance or an application for issuing a certificate of the right to inheritance. The inheritance may be accepted within six months from the date of the opening of the inheritance, i.e. within six months from the date of death of the testator.
Given the above, we recommend that you contact a notary at the place of opening of the inheritance (this is the place of residence of the deceased person).
For information, we inform you that:
1) in accordance with the Law, the UAPF is obliged to make pension payments to recipients in the manner established by the Government of the Republic of Kazakhstan. The specified procedure, as well as the list of required documents, are determined by the Rules for making pension payments, lump-sum pension payments in order to improve housing conditions and (or) pay for treatment, formed at the expense of mandatory pension contributions, mandatory professional pension contributions from the unified accumulative pension fund, their return to the UAPF approved as amended by the Decree of the Government of the Republic of Kazakhstan;
2) in accordance with the Law, in the event of the death of the recipient, as well as a person who has pension savings in the UAPF and has not reached retirement age in accordance with paragraphs 1-3 of Article 11 of the Law, his family or the person who performed the burial, the UAPF is paid a lump-sum payment for burial within the amount of 52.4 times the monthly calculation index established for the corresponding financial year by the law on the republican budget, but not more than the funds available on the individual pension account;
3) the UAPF website at www.enpf.kz contains a list of required documents, requirements for their execution, addresses of UAPF regional divisions.
